公司總是給放假,可以辭職嗎?

答 根據(ju)《勞(lao)動(dong)(dong)合同(tong)(tong)法》第38條規定,單位(wei)未按(an)照勞(lao)動(dong)(dong)合同(tong)(tong)約(yue)定提(ti)供(gong)勞(lao)動(dong)(dong)保護或(huo)者(zhe)(zhe)勞(lao)動(dong)(dong)條件(jian)(jian)的(de),勞(lao)動(dong)(dong)者(zhe)(zhe)可以(yi)解除勞(lao)動(dong)(dong)合同(tong)(tong)。 如果單位(wei)安排勞(lao)動(dong)(dong)者(zhe)(zhe)工(gong)作(zuo)的(de)環境和工(gong)作(zuo)條件(jian)(jian)惡劣(lie),存在安全隱(yin)患或(huo)漏洞,有可能給(gei)勞(lao)動(dong)(dong)者(zhe)(zhe)的(de)安全帶來威脅;或(huo)者(zhe)(zhe)勞(lao)動(dong)(dong)者(zhe)(zhe)的(de)工(gong)作(zuo)環境與(yu)勞(lao)動(dong)(dong)合同(tong)(tong)約(yue)定的(de)內容不符(fu),勞(lao)動(dong)(dong)者(zhe)(zhe)都可以(yi)以(yi)此理(li)由提(ti)出(chu)解除勞(lao)動(dong)(dong)合同(tong)(tong)。 用人單位(wei)隨意(yi)強行給(gei)員工(gong)“放假”或(huo)“停工(gong)”,無疑剝奪了勞(lao)動(dong)(dong)者(zhe)(zhe)的(de)工(gong)作(zuo)權利,讓勞(lao)動(dong)(dong)者(zhe)(zhe)失(shi)去(qu)賴以(yi)工(gong)作(zuo)的(de)基本條件(jian)(jian),因此可視為未提(ti)供(gong)勞(lao)動(dong)(dong)條件(jian)(jian)。
