根(gen)據《勞(lao)動(dong)(dong)法(fa)》第七(qi)十(shi)九條:勞(lao)動(dong)(dong)爭(zheng)(zheng)議(yi)發生后,當事人(ren)(ren)(ren)(ren)可(ke)(ke)以(yi)向本單位(wei)勞(lao)動(dong)(dong)爭(zheng)(zheng)議(yi)調解委員(yuan)會申(shen)請(qing)調解;調解不(bu)成,當事人(ren)(ren)(ren)(ren)一方要求仲(zhong)(zhong)裁(cai)(cai)的,可(ke)(ke)以(yi)向勞(lao)動(dong)(dong)爭(zheng)(zheng)議(yi)仲(zhong)(zhong)裁(cai)(cai)委員(yuan)會申(shen)請(qing)仲(zhong)(zhong)裁(cai)(cai)。當事人(ren)(ren)(ren)(ren)一方也可(ke)(ke)以(yi)直接(jie)向勞(lao)動(dong)(dong)爭(zheng)(zheng)議(yi)仲(zhong)(zhong)裁(cai)(cai)委員(yuan)會申(shen)請(qing)仲(zhong)(zhong)裁(cai)(cai)。對仲(zhong)(zhong)裁(cai)(cai)裁(cai)(cai)決(jue)不(bu)服的,可(ke)(ke)以(yi)向人(ren)(ren)(ren)(ren)民法(fa)院提起訴訟。所(suo)以(yi)你的同事可(ke)(ke)以(yi)申(shen)請(qing)仲(zhong)(zhong)裁(cai)(cai)看一下(xia)哦,這樣爭(zheng)(zheng)下(xia)去也不(bu)是辦法(fa)。
