公司規定試用期內不繳納五險一金,是否合法?
問 最近剛進入濟(ji)南(nan)的一(yi)家公司上班,公司規定(ding)試用期(qi)內(nei)部繳納五險(xian)一(yi)金,成為正式員工才(cai)給繳納,這樣合法嗎?
答 依據《社會(hui)(hui)(hui)保(bao)險(xian)法》第(di)五(wu)十八(ba)條“用(yong)(yong)人(ren)單(dan)(dan)位應(ying)當自用(yong)(yong)工(gong)(gong)之日起三十日內為其(qi)職(zhi)工(gong)(gong)向社會(hui)(hui)(hui)保(bao)險(xian)經辦機構申請辦理社會(hui)(hui)(hui)保(bao)險(xian)登記”,社會(hui)(hui)(hui)保(bao)險(xian)即五(wu)險(xian)一(yi)金(jin)的(de)(de)繳(jiao)納本身和試用(yong)(yong)期(qi)沒有(you)關(guan)聯。實務中用(yong)(yong)人(ren)單(dan)(dan)位基于成本的(de)(de)考(kao)量(liang)作(zuo)出類似(si)的(de)(de)規定,本身具有(you)違(wei)法性,可能會(hui)(hui)(hui)引發兩(liang)方面的(de)(de)法律(lv)后果:(1)職(zhi)工(gong)(gong)以用(yong)(yong)人(ren)單(dan)(dan)位規章制度(du)違(wei)法、損害自身利益為由(you)提出解除勞動合同,并要(yao)求(qiu)單(dan)(dan)位支付經濟補償金(jin);(2)屬于違(wei)反《社會(hui)(hui)(hui)保(bao)險(xian)法》的(de)(de)規定,一(yi)旦勞動監(jian)察或者社保(bao)稽核部(bu)門審查,需要(yao)承(cheng)擔一(yi)定的(de)(de)行政責任。
