公司規定試用期內不繳納五險一金,是否合法?

答 依(yi)據(ju)《社會(hui)(hui)(hui)保險(xian)(xian)(xian)法(fa)》第五(wu)十八條“用(yong)(yong)人(ren)單(dan)位(wei)(wei)應當自(zi)用(yong)(yong)工之日(ri)起(qi)三十日(ri)內為其職工向社會(hui)(hui)(hui)保險(xian)(xian)(xian)經(jing)(jing)辦(ban)機構申請辦(ban)理社會(hui)(hui)(hui)保險(xian)(xian)(xian)登記”,社會(hui)(hui)(hui)保險(xian)(xian)(xian)即五(wu)險(xian)(xian)(xian)一金的(de)(de)繳納本(ben)身和試用(yong)(yong)期沒有關聯。實務中(zhong)用(yong)(yong)人(ren)單(dan)位(wei)(wei)基于成本(ben)的(de)(de)考量作出類似的(de)(de)規定,本(ben)身具(ju)有違(wei)法(fa)性,可(ke)能會(hui)(hui)(hui)引(yin)發兩方面的(de)(de)法(fa)律后(hou)果:(1)職工以用(yong)(yong)人(ren)單(dan)位(wei)(wei)規章(zhang)制(zhi)度違(wei)法(fa)、損(sun)害自(zi)身利(li)益(yi)為由(you)提出解除(chu)勞動(dong)合同(tong),并要求(qiu)單(dan)位(wei)(wei)支付經(jing)(jing)濟(ji)補償金;(2)屬(shu)于違(wei)反《社會(hui)(hui)(hui)保險(xian)(xian)(xian)法(fa)》的(de)(de)規定,一旦勞動(dong)監(jian)察或(huo)者社保稽核部(bu)門(men)審(shen)查,需要承擔一定的(de)(de)行政責任(ren)。
