什么情形下被派遣員工可以解除勞動合同?

問(wen) 我是一名新(xin)入(ru)職的員工(gong),公(gong)司可能(neng)會在新(xin)進(jin)員工(gong)里面選(xuan)擇幾個人(ren)去西部(bu)的分公(gong)司,什么情形下被派遣員工(gong)可以解除勞動合同?

(1)未(wei)(wei)按照勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)約定(ding)提供勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)保護或者勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)條件的(de); (2)未(wei)(wei)及時足(zu)額支付勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)報酬的(de); (3)未(wei)(wei)依法(fa)(fa)為勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者繳納社會保險費的(de); (4)用人(ren)(ren)(ren)單位(wei)的(de)規(gui)章(zhang)(zhang)制度違反(fan)法(fa)(fa)律、法(fa)(fa)規(gui)的(de)規(gui)定(ding),損害勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者權益的(de); (5)因(yin)用人(ren)(ren)(ren)單位(wei)用欺詐、脅迫的(de)手段(duan)或者乘人(ren)(ren)(ren)之危(wei),使勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者在(zai)違背真實意思的(de)情況下訂立(li)或者變更勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)(tong),致(zhi)使勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)無效的(de); (6)法(fa)(fa)律、行政(zheng)法(fa)(fa)規(gui)規(gui)定(ding)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者可(ke)以(yi)解除(chu)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)的(de)其他情形。 用人(ren)(ren)(ren)單位(wei)以(yi)暴(bao)力(li)、威(wei)脅或者非法(fa)(fa)限制人(ren)(ren)(ren)身自(zi)由的(de)手段(duan)強迫勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)的(de),或者用人(ren)(ren)(ren)單位(wei)違章(zhang)(zhang)指揮、強令冒(mao)險作(zuo)業危(wei)及勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者人(ren)(ren)(ren)身安全的(de),勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者可(ke)以(yi)立(li)即解除(chu)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)(tong)(tong),不需事先告(gao)知用人(ren)(ren)(ren)單位(wei)。
