什么情況下辭退員工要支付經濟補償?
問 我(wo)是(shi)一名(ming)機械工(gong)(gong)人(ren),在一家私企工(gong)(gong)作四年了(le),前(qian)段時間(jian)在工(gong)(gong)作中受傷了(le),公司要和我(wo)接觸合同,是(shi)不是(shi)應該給我(wo)一些(xie)經濟補償?
答(da) 勞(lao)(lao)(lao)動(dong)合同(tong)(tong)法》第40條(tiao)規(gui)定:在(zai)以下三(san)種情形下,用(yong)人單位(wei)(wei)向勞(lao)(lao)(lao)動(dong)者(zhe)(zhe)(zhe)(zhe)提出解除(chu)勞(lao)(lao)(lao)動(dong)合同(tong)(tong)時,應支付經(jing)濟補償金: (1)勞(lao)(lao)(lao)動(dong)者(zhe)(zhe)(zhe)(zhe)患病(bing)或者(zhe)(zhe)(zhe)(zhe)非(fei)因工(gong)負傷(shang),在(zai)規(gui)定的(de)醫療期滿后(hou)不能(neng)(neng)(neng)從事(shi)原工(gong)作(zuo),也(ye)不能(neng)(neng)(neng)從事(shi)由用(yong)人單位(wei)(wei)另行(xing)安排(pai)的(de)工(gong)作(zuo)的(de); (2)勞(lao)(lao)(lao)動(dong)者(zhe)(zhe)(zhe)(zhe)不能(neng)(neng)(neng)勝任工(gong)作(zuo),經(jing)過培(pei)訓或者(zhe)(zhe)(zhe)(zhe)調整工(gong)作(zuo)崗(gang)位(wei)(wei),仍(reng)不能(neng)(neng)(neng)勝任工(gong)作(zuo)的(de); (3)勞(lao)(lao)(lao)動(dong)合同(tong)(tong)訂立時所依(yi)據的(de)客觀情況發生重大變(bian)化,致(zhi)使勞(lao)(lao)(lao)動(dong)合同(tong)(tong)無(wu)法履行(xing),經(jing)用(yong)人單位(wei)(wei)與勞(lao)(lao)(lao)動(dong)者(zhe)(zhe)(zhe)(zhe)協商,未能(neng)(neng)(neng)就變(bian)更勞(lao)(lao)(lao)動(dong)合同(tong)(tong)內(nei)容達成(cheng)協議的(de)。
