什么情況下辭退員工要支付經濟補償?

我(wo)是一(yi)名機械工(gong)人,在一(yi)家私企工(gong)作(zuo)四(si)年了(le),前(qian)段時間(jian)在工(gong)作(zuo)中受(shou)傷了(le),公司要(yao)和我(wo)接觸合同,是不是應(ying)該給我(wo)一(yi)些經(jing)濟補償(chang)?

勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同法(fa)》第40條規定(ding):在以下三(san)種情形(xing)下,用(yong)(yong)人(ren)單位(wei)向勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)提出解除勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同時,應支付(fu)經(jing)濟補償金: (1)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)患(huan)病(bing)或者(zhe)(zhe)(zhe)非因工負(fu)傷,在規定(ding)的(de)醫(yi)療(liao)期滿后不能從事原工作,也(ye)不能從事由用(yong)(yong)人(ren)單位(wei)另行(xing)安排的(de)工作的(de); (2)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)不能勝(sheng)任工作,經(jing)過培訓(xun)或者(zhe)(zhe)(zhe)調整(zheng)工作崗位(wei),仍不能勝(sheng)任工作的(de); (3)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同訂立時所依據的(de)客(ke)觀情況發生重大變化(hua),致使勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同無法(fa)履行(xing),經(jing)用(yong)(yong)人(ren)單位(wei)與勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)協商,未能就(jiu)變更勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同內容達成協議(yi)的(de)。
