什么情況下辭退員工要支付經濟補償?
問(wen) 我是一名機械工(gong)(gong)人,在(zai)一家私企工(gong)(gong)作(zuo)四年了(le)(le),前段時間在(zai)工(gong)(gong)作(zuo)中受傷了(le)(le),公司要和(he)我接(jie)觸合同,是不是應(ying)該給我一些經濟補償?
答 勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)法(fa)》第40條規定(ding):在以(yi)下三種情形下,用(yong)人(ren)單(dan)位(wei)向勞(lao)(lao)動(dong)(dong)(dong)者提出解除勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)時(shi)(shi),應支付經(jing)濟補(bu)償金: (1)勞(lao)(lao)動(dong)(dong)(dong)者患病或者非(fei)因工(gong)(gong)(gong)(gong)負(fu)傷,在規定(ding)的(de)(de)醫(yi)療(liao)期滿后不能(neng)(neng)從事原工(gong)(gong)(gong)(gong)作(zuo)(zuo),也不能(neng)(neng)從事由用(yong)人(ren)單(dan)位(wei)另(ling)行安排的(de)(de)工(gong)(gong)(gong)(gong)作(zuo)(zuo)的(de)(de); (2)勞(lao)(lao)動(dong)(dong)(dong)者不能(neng)(neng)勝任(ren)工(gong)(gong)(gong)(gong)作(zuo)(zuo),經(jing)過(guo)培訓或者調整工(gong)(gong)(gong)(gong)作(zuo)(zuo)崗位(wei),仍不能(neng)(neng)勝任(ren)工(gong)(gong)(gong)(gong)作(zuo)(zuo)的(de)(de); (3)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)訂立時(shi)(shi)所依據的(de)(de)客(ke)觀情況發(fa)生重大(da)變化,致使(shi)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)無法(fa)履行,經(jing)用(yong)人(ren)單(dan)位(wei)與勞(lao)(lao)動(dong)(dong)(dong)者協商,未能(neng)(neng)就變更勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)內容達成協議的(de)(de)。
