勞(lao)動者(zhe)同(tong)(tong)時與(yu)其他用(yong)人單(dan)(dan)(dan)位(wei)建(jian)立勞(lao)動關系,對(dui)完(wan)成(cheng)本單(dan)(dan)(dan)位(wei)的工作(zuo)任(ren)(ren)務(wu)造成(cheng)嚴重影響,或者(zhe)經用(yong)人單(dan)(dan)(dan)位(wei)提(ti)出,拒不改正的,用(yong)人單(dan)(dan)(dan)位(wei)可(ke)以解除勞(lao)動合(he)同(tong)(tong)。 勞(lao)動者(zhe)與(yu)其他單(dan)(dan)(dan)位(wei)建(jian)立勞(lao)動關系(以下簡(jian)稱“兼(jian)職”),用(yong)人單(dan)(dan)(dan)位(wei)解除勞(lao)動合(he)同(tong)(tong)的,需要具備(bei)以下條件之一: (1)兼(jian)職對(dui)完(wan)成(cheng)本單(dan)(dan)(dan)位(wei)工作(zuo)任(ren)(ren)務(wu)造成(cheng)嚴重影響; (2)用(yong)人單(dan)(dan)(dan)位(wei)對(dui)兼(jian)職提(ti)出反對(dui)意見,勞(lao)動者(zhe)拒不改正。
