什么情況下用人單位不能解除勞動合同?

我是一名文(wen)員(yuan),最(zui)近(jin)公司正在(zai)裁員(yuan),什么情況下用人單位不能(neng)解除勞動合同?

《勞(lao)(lao)動(dong)合同(tong)法》第(di)42條規定(ding)(ding):勞(lao)(lao)動(dong)者有(you)下列情形(xing)之一的(de),用人單位(wei)不得依照(zhao)本法第(di)40條、第(di)41條的(de)規定(ding)(ding)解除勞(lao)(lao)動(dong)合同(tong): (1)從事接觸(chu)職(zhi)業病危(wei)害作業的(de)勞(lao)(lao)動(dong)者未進行(xing)(xing)離崗前職(zhi)業健(jian)康檢查(cha),或(huo)者疑似職(zhi)業病病人在(zai)診斷或(huo)者醫學(xue)觀(guan)察期(qi)(qi)間的(de); (2)在(zai)本單位(wei)患職(zhi)業病或(huo)者因工(gong)(gong)(gong)負傷并被確(que)認喪失或(huo)者部分喪失勞(lao)(lao)動(dong)能力(li)的(de); (3)患病或(huo)者非因工(gong)(gong)(gong)負傷,在(zai)規定(ding)(ding)的(de)醫療期(qi)(qi)內的(de); (4)女職(zhi)工(gong)(gong)(gong)在(zai)孕期(qi)(qi)、產期(qi)(qi)、哺乳期(qi)(qi)的(de); (5)在(zai)本單位(wei)連續工(gong)(gong)(gong)作滿十五年(nian)(nian),且(qie)距(ju)法定(ding)(ding)退休年(nian)(nian)齡不足(zu)五年(nian)(nian)的(de); (6)法律、行(xing)(xing)政法規規定(ding)(ding)的(de)其他情形(xing)。
