問 公(gong)司一直沒有與我(wo)簽(qian)訂勞動(dong)合同,現在(zai)我(wo)們之間發生薪資糾紛了,請問公(gong)司是否(fou)該履(lv)行責(ze)任(ren)?
答 公(gong)司(si)(si)應該履行責任(ren)。《勞動(dong)(dong)合同法》規定,用(yong)人單位自(zi)用(yong)工(gong)之(zhi)日起(qi)即與勞動(dong)(dong)者建立(li)勞動(dong)(dong)關(guan)系。因此,即使沒有勞動(dong)(dong)合同,只要存(cun)在用(yong)工(gong)關(guan)系,發生薪(xin)資糾紛或者工(gong)傷(shang),也應當由(you)公(gong)司(si)(si)按照勞動(dong)(dong)法的有關(guan)規定來處理。
