離職已經三個月了,可申請仲裁嗎?
問 我(wo)從公司離職已(yi)經超過(guo)三個月了,因(yin)為一些問題發(fa)生糾紛,還可以(yi)申請仲裁嗎?
答 離職后一(yi)(yi)年(nian)內可(ke)(ke)以申(shen)請(qing)(qing)勞動仲(zhong)(zhong)(zhong)(zhong)裁。 《中(zhong)華人民共和國(guo)勞動爭(zheng)(zheng)議調解仲(zhong)(zhong)(zhong)(zhong)裁法》第二十七條(tiao)規(gui)定(ding):“ 勞動爭(zheng)(zheng)議申(shen)請(qing)(qing)仲(zhong)(zhong)(zhong)(zhong)裁的(de)時(shi)(shi)效(xiao)期(qi)(qi)(qi)(qi)間為一(yi)(yi)年(nian)。仲(zhong)(zhong)(zhong)(zhong)裁時(shi)(shi)效(xiao)期(qi)(qi)(qi)(qi)間從(cong)(cong)(cong)當(dang)(dang)(dang)事(shi)人知道或者應當(dang)(dang)(dang)知道其權利被侵(qin)害之日(ri)起(qi)計(ji)(ji)算。 前款(kuan)規(gui)定(ding)的(de)仲(zhong)(zhong)(zhong)(zhong)裁時(shi)(shi)效(xiao),因(yin)當(dang)(dang)(dang)事(shi)人一(yi)(yi)方向對方當(dang)(dang)(dang)事(shi)人主張權利,或者向有關(guan)(guan)(guan)部門請(qing)(qing)求權利救濟,或者對方當(dang)(dang)(dang)事(shi)人同(tong)意(yi)履行(xing)義務而中(zhong)斷(duan)。從(cong)(cong)(cong)中(zhong)斷(duan)時(shi)(shi)起(qi),仲(zhong)(zhong)(zhong)(zhong)裁時(shi)(shi)效(xiao)期(qi)(qi)(qi)(qi)間重新計(ji)(ji)算。 因(yin)不可(ke)(ke)抗力(li)或者有其他正當(dang)(dang)(dang)理由,當(dang)(dang)(dang)事(shi)人不能(neng)在本條(tiao)第一(yi)(yi)款(kuan)規(gui)定(ding)的(de)仲(zhong)(zhong)(zhong)(zhong)裁時(shi)(shi)效(xiao)期(qi)(qi)(qi)(qi)間申(shen)請(qing)(qing)仲(zhong)(zhong)(zhong)(zhong)裁的(de),仲(zhong)(zhong)(zhong)(zhong)裁時(shi)(shi)效(xiao)中(zhong)止。從(cong)(cong)(cong)中(zhong)止時(shi)(shi)效(xiao)的(de)原因(yin)消除之日(ri)起(qi),仲(zhong)(zhong)(zhong)(zhong)裁時(shi)(shi)效(xiao)期(qi)(qi)(qi)(qi)間繼續計(ji)(ji)算。 勞動關(guan)(guan)(guan)系(xi)存續期(qi)(qi)(qi)(qi)間因(yin)拖欠勞動報酬發生爭(zheng)(zheng)議的(de),勞動者申(shen)請(qing)(qing)仲(zhong)(zhong)(zhong)(zhong)裁不受本條(tiao)第一(yi)(yi)款(kuan)規(gui)定(ding)的(de)仲(zhong)(zhong)(zhong)(zhong)裁時(shi)(shi)效(xiao)期(qi)(qi)(qi)(qi)間的(de)限制;但是,勞動關(guan)(guan)(guan)系(xi)終止的(de),應當(dang)(dang)(dang)自勞動關(guan)(guan)(guan)系(xi)終止之日(ri)起(qi)一(yi)(yi)年(nian)內提(ti)出(chu)。”
