答 根(gen)據《勞動(dong)合同法實施條(tiao)例》第5條(tiao)規(gui)定,自用(yong)工(gong)之日起(qi)一(yi)個(ge)月內,經用(yong)人單(dan)(dan)位書面(mian)通(tong)知后,勞動(dong)者(zhe)不與用(yong)人單(dan)(dan)位訂立書面(mian)勞動(dong)合同的,用(yong)人單(dan)(dan)位應(ying)當書面(mian)通(tong)知勞動(dong)者(zhe)終止勞動(dong)關系,無需(xu)向勞動(dong)者(zhe)支付(fu)經濟補償(chang),但是應(ying)當依法向勞動(dong)者(zhe)支付(fu)其實際(ji)工(gong)作時(shi)間的勞動(dong)報酬。
