問 職工拒簽勞動(dong)合同,單(dan)位(wei)終(zhong)止勞動(dong)關系(xi),依(yi)照法律(lv)單(dan)位(wei)還需要給勞動(dong)者補償嗎?
答 根據《勞(lao)(lao)(lao)動(dong)(dong)合同法實(shi)施條(tiao)例(li)》第5條(tiao)規(gui)定,自(zi)用(yong)(yong)工之日起一(yi)個月內,經用(yong)(yong)人單(dan)位書(shu)面通(tong)知后,勞(lao)(lao)(lao)動(dong)(dong)者不與用(yong)(yong)人單(dan)位訂立(li)書(shu)面勞(lao)(lao)(lao)動(dong)(dong)合同的,用(yong)(yong)人單(dan)位應(ying)當書(shu)面通(tong)知勞(lao)(lao)(lao)動(dong)(dong)者終止勞(lao)(lao)(lao)動(dong)(dong)關系,無需(xu)向(xiang)勞(lao)(lao)(lao)動(dong)(dong)者支(zhi)(zhi)付經濟補償,但是應(ying)當依法向(xiang)勞(lao)(lao)(lao)動(dong)(dong)者支(zhi)(zhi)付其實(shi)際工作時間的勞(lao)(lao)(lao)動(dong)(dong)報(bao)酬。
