答 這樣肯定是不(bu)合法的(de),按(an)照《勞(lao)(lao)(lao)動(dong)(dong)合同(tong)法》,用(yong)(yong)人(ren)單位不(bu)得以任何(he)借口扣押勞(lao)(lao)(lao)動(dong)(dong)者的(de)財物。勞(lao)(lao)(lao)動(dong)(dong)者的(de)工資在雙方(fang)沒有另外(wai)約定的(de)情況下,用(yong)(yong)人(ren)單位宜按(an)月結算。同(tong)時,《勞(lao)(lao)(lao)動(dong)(dong)合同(tong)法》還規定無論(lun)勞(lao)(lao)(lao)動(dong)(dong)合同(tong)是否約定期限(xian),勞(lao)(lao)(lao)動(dong)(dong)者只(zhi)要提前30日,以書(shu)面形(xing)式通知用(yong)(yong)人(ren)單位,就可以解除勞(lao)(lao)(lao)動(dong)(dong)合同(tong)。如果(guo)是還在試用(yong)(yong)期的(de)話(hua),勞(lao)(lao)(lao)動(dong)(dong)者只(zhi)需(xu)提前3天即可。
