答 《勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)法》第48條規定(ding),用(yong)人單(dan)位(wei)違(wei)反本法規定(ding)解(jie)除或者終(zhong)止勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong),勞(lao)動(dong)(dong)(dong)者要求(qiu)繼(ji)(ji)續(xu)履(lv)行(xing)勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)的(de)(de),用(yong)人單(dan)位(wei)應當繼(ji)(ji)續(xu)履(lv)行(xing);勞(lao)動(dong)(dong)(dong)者不要求(qiu)繼(ji)(ji)續(xu)履(lv)行(xing)勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)或者勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)已經(jing)不能繼(ji)(ji)續(xu)履(lv)行(xing)的(de)(de),應按(an)照規定(ding)的(de)(de)經(jing)濟補償標(biao)準的(de)(de)二倍向勞(lao)動(dong)(dong)(dong)者支付賠償金。
