《勞(lao)動(dong)爭議(yi)調(diao)解仲(zhong)(zhong)裁(cai)法(fa)》第27條(tiao)規(gui)定:勞(lao)動(dong)爭議(yi)申(shen)(shen)請仲(zhong)(zhong)裁(cai)的(de)時(shi)效期(qi)間為1年,仲(zhong)(zhong)裁(cai)時(shi)效期(qi)間從當事人(ren)知(zhi)(zhi)道(dao)(dao)或(huo)者應(ying)當知(zhi)(zhi)道(dao)(dao)其權(quan)(quan)利被(bei)(bei)侵(qin)害之(zhi)日(ri)起計算(suan)。當事人(ren)應(ying)當自(zi)知(zhi)(zhi)道(dao)(dao)或(huo)者應(ying)當知(zhi)(zhi)道(dao)(dao)權(quan)(quan)利被(bei)(bei)侵(qin)害之(zhi)日(ri)起一(yi)年內向仲(zhong)(zhong)裁(cai)未提出書面申(shen)(shen)請,無正當理由逾期(qi)提出申(shen)(shen)請的(de)為超(chao)過(guo)訴訟時(shi)效超(chao)過(guo)仲(zhong)(zhong)裁(cai)時(shi)效申(shen)(shen)請勞(lao)動(dong)仲(zhong)(zhong)裁(cai),又不能證明有中止、中斷事由的(de),將承(cheng)擔喪失勝訴權(quan)(quan)的(de)風(feng)險。
