答(da) 根據(ju)《勞(lao)(lao)動(dong)(dong)合同法實施條例》第5條規定,自用(yong)工(gong)之日起(qi)一個(ge)月內,經用(yong)人(ren)單位(wei)(wei)書(shu)(shu)面通(tong)知后,勞(lao)(lao)動(dong)(dong)者(zhe)不與用(yong)人(ren)單位(wei)(wei)訂(ding)立書(shu)(shu)面勞(lao)(lao)動(dong)(dong)合同的(de),用(yong)人(ren)單位(wei)(wei)應當書(shu)(shu)面通(tong)知勞(lao)(lao)動(dong)(dong)者(zhe)終止勞(lao)(lao)動(dong)(dong)關系,無需向勞(lao)(lao)動(dong)(dong)者(zhe)支付經濟(ji)補(bu)償,但是應當依法向勞(lao)(lao)動(dong)(dong)者(zhe)支付其實際(ji)工(gong)作時間的(de)勞(lao)(lao)動(dong)(dong)報酬(chou)。
