答 根(gen)據(ju)我的了解(jie)《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同法》第二十三(san)條(tiao)第二款規定(ding):“對負有保密義務的勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者,用人單位(wei)可以在(zai)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同或(huo)者保密協(xie)議(yi)中與勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者約(yue)定(ding)競業(ye)限(xian)(xian)制(zhi)(zhi)條(tiao)款,并約(yue)定(ding)在(zai)解(jie)除或(huo)者終止(zhi)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同后,在(zai)競業(ye)限(xian)(xian)制(zhi)(zhi)期限(xian)(xian)內按月給(gei)予勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者經濟補償。勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者違反競業(ye)限(xian)(xian)制(zhi)(zhi)約(yue)定(ding)的,應當按照約(yue)定(ding)向用人單位(wei)支(zhi)付違約(yue)金(jin)。”
