哪些情況下用人單位減發員工工資不屬于克扣工資行為?
問 我們公司最近要降(jiang)薪(xin),請問哪些(xie)情(qing)況下(xia)用人單位(wei)減(jian)發員工(gong)(gong)工(gong)(gong)資(zi)不(bu)屬于克扣工(gong)(gong)資(zi)行為?
答 用(yong)(yong)人(ren)單(dan)位必須按照勞動(dong)合同(tong)約定(ding)的(de)(de)工(gong)(gong)資(zi)標準全(quan)額向勞動(dong)者支付工(gong)(gong)資(zi),否則,將(jiang)構成克扣(kou)工(gong)(gong)資(zi)的(de)(de)行(xing)為。但在下列情況下,用(yong)(yong)人(ren)單(dan)位減發(fa)工(gong)(gong)資(zi),不屬于(yu)克扣(kou)工(gong)(gong)資(zi)的(de)(de)行(xing)為: (1)國家的(de)(de)法律(lv)、法規中有明(ming)確規定(ding)的(de)(de); (2)依法簽訂的(de)(de)勞動(dong)合同(tong)中有明(ming)確規定(ding)的(de)(de); (3)用(yong)(yong)人(ren)單(dan)位依法制(zhi)定(ding)并經(jing)職代會批準的(de)(de)廠規、廠紀中有明(ming)確規定(ding)的(de)(de); (4)企業工(gong)(gong)資(zi)總額與經(jing)濟效(xiao)益相聯系,經(jing)濟效(xiao)益下浮(fu)時,工(gong)(gong)資(zi)必須下浮(fu)的(de)(de)(但支付給勞動(dong)的(de)(de)工(gong)(gong)資(zi)不得低(di)(di)于(yu)當地(di)的(de)(de)最(zui)低(di)(di)工(gong)(gong)資(zi)標準); (5)因勞動(dong)者請(qing)事假等(deng)相應(ying)減發(fa)工(gong)(gong)資(zi)等(deng)。
