答 根據《勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)法》第23條第二款(kuan)規定(ding):單位與勞(lao)(lao)動(dong)(dong)(dong)者簽訂“競(jing)(jing)(jing)業(ye)限(xian)制(zhi)”條款(kuan)的同(tong)時(shi),要約(yue)定(ding)在解除(chu)或者終止勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)后(hou),在競(jing)(jing)(jing)業(ye)限(xian)制(zhi)期限(xian)內按月給(gei)予(yu)勞(lao)(lao)動(dong)(dong)(dong)者經(jing)濟(ji)補(bu)償(chang)。補(bu)償(chang)金(jin)的數額由雙方約(yue)定(ding)。用人(ren)單位未(wei)按照(zhao)約(yue)定(ding)在勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)解除(chu)后(hou)向勞(lao)(lao)動(dong)(dong)(dong)者支付競(jing)(jing)(jing)業(ye)限(xian)制(zhi)經(jing)濟(ji)補(bu)償(chang)的,競(jing)(jing)(jing)業(ye)限(xian)制(zhi)條款(kuan)失效(xiao)。
