根據《勞(lao)動(dong)合(he)(he)同(tong)法》第(di)23條(tiao)(tiao)第(di)二(er)款(kuan)規定(ding):單(dan)(dan)位(wei)與勞(lao)動(dong)者簽訂“競業限(xian)(xian)制(zhi)”條(tiao)(tiao)款(kuan)的(de)同(tong)時(shi),要約定(ding)在(zai)(zai)解(jie)除(chu)或者終止勞(lao)動(dong)合(he)(he)同(tong)后,在(zai)(zai)競業限(xian)(xian)制(zhi)期(qi)限(xian)(xian)內按(an)月給予勞(lao)動(dong)者經濟(ji)補(bu)(bu)償。補(bu)(bu)償金的(de)數(shu)額由(you)雙(shuang)方約定(ding)。用人單(dan)(dan)位(wei)未按(an)照約定(ding)在(zai)(zai)勞(lao)動(dong)合(he)(he)同(tong)解(jie)除(chu)后向勞(lao)動(dong)者支付競業限(xian)(xian)制(zhi)經濟(ji)補(bu)(bu)償的(de),競業限(xian)(xian)制(zhi)條(tiao)(tiao)款(kuan)失(shi)效(xiao)。
