哪些情形下用人單位辭退職工需要支付經濟補償?
問 我的一(yi)個(ge)朋友(you)被辭(ci)退了,單(dan)位說辭(ci)退的情形不需要給她經濟(ji)補償(chang),請問哪些情形下用人(ren)單(dan)位辭(ci)退職工需要支(zhi)付經濟(ji)補償(chang)?
答 在以下三種情形下,用(yong)人(ren)(ren)單(dan)位(wei)向(xiang)勞(lao)(lao)動(dong)(dong)者(zhe)提出解除勞(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)時(shi),應支付經濟補(bu)償金: (1)勞(lao)(lao)動(dong)(dong)者(zhe)患病或者(zhe)非因工(gong)負傷,在規定的(de)(de)(de)醫療期滿后不(bu)能(neng)從(cong)(cong)事原工(gong)作(zuo)(zuo),也不(bu)能(neng)從(cong)(cong)事由(you)用(yong)人(ren)(ren)單(dan)位(wei)另行安排的(de)(de)(de)工(gong)作(zuo)(zuo)的(de)(de)(de); (2)勞(lao)(lao)動(dong)(dong)者(zhe)不(bu)能(neng)勝(sheng)任工(gong)作(zuo)(zuo),經過培訓或者(zhe)調整工(gong)作(zuo)(zuo)崗位(wei),仍不(bu)能(neng)勝(sheng)任工(gong)作(zuo)(zuo)的(de)(de)(de); (3)勞(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)訂立時(shi)所依(yi)據(ju)的(de)(de)(de)客觀(guan)情況(kuang)發生重大變(bian)化,致使勞(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)無法履行,經用(yong)人(ren)(ren)單(dan)位(wei)與勞(lao)(lao)動(dong)(dong)者(zhe)協商,未(wei)能(neng)就變(bian)更勞(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)內容達成協議的(de)(de)(de)。
