用人單位“炒人”必須事先通知工會嗎?

答(da) 《勞(lao)動合(he)(he)(he)同(tong)(tong)法》中規(gui)定,當(dang)用人(ren)單(dan)(dan)位單(dan)(dan)方提出(chu)解(jie)除(chu)(chu)勞(lao)動合(he)(he)(he)同(tong)(tong)時(shi),應(ying)當(dang)事先將理由(you)通知工(gong)(gong)(gong)會(hui)。工(gong)(gong)(gong)會(hui)需對用人(ren)單(dan)(dan)位作出(chu)的單(dan)(dan)方解(jie)除(chu)(chu)勞(lao)動合(he)(he)(he)同(tong)(tong)決定進行(xing)審查,如果(guo)發(fa)現用人(ren)單(dan)(dan)位違(wei)反法律、行(xing)政法規(gui)規(gui)定或者勞(lao)動合(he)(he)(he)同(tong)(tong)約(yue)定的,工(gong)(gong)(gong)會(hui)有權要求用人(ren)單(dan)(dan)位糾(jiu)正。用人(ren)單(dan)(dan)位應(ying)當(dang)研究工(gong)(gong)(gong)會(hui)的意(yi)見,并將處理結果(guo)書面通知工(gong)(gong)(gong)會(hui)。 因此,單(dan)(dan)位在向勞(lao)動者發(fa)出(chu)解(jie)除(chu)(chu)勞(lao)動合(he)(he)(he)同(tong)(tong)的書面通知之(zhi)前,應(ying)當(dang)首先通知工(gong)(gong)(gong)會(hui),工(gong)(gong)(gong)會(hui)認為(wei)無異(yi)議的,單(dan)(dan)位方可以決定“炒人(ren)”。
