勞動者違反競業限制約定后要交違約金嗎?

答 《勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)法》第(di)23條(tiao)規定(ding)(ding)(ding)(ding):“用(yong)人(ren)(ren)單(dan)位(wei)(wei)與(yu)(yu)勞(lao)(lao)(lao)(lao)動(dong)者(zhe)可以(yi)在(zai)勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)中(zhong)約(yue)定(ding)(ding)(ding)(ding)保(bao)守用(yong)人(ren)(ren)單(dan)位(wei)(wei)的(de)(de)商業(ye)秘密 和與(yu)(yu)知識產權(quan)相關(guan)的(de)(de)保(bao)密事(shi)項(xiang)。對負有保(bao)密義務的(de)(de)勞(lao)(lao)(lao)(lao)動(dong)者(zhe),用(yong)人(ren)(ren)單(dan)位(wei)(wei)可以(yi)在(zai)勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)或者(zhe)保(bao)密協議中(zhong)與(yu)(yu)勞(lao)(lao)(lao)(lao)動(dong)者(zhe)約(yue)定(ding)(ding)(ding)(ding)競業(ye)限(xian)制(zhi)條(tiao)款,并約(yue)定(ding)(ding)(ding)(ding)在(zai)解除或者(zhe)終止勞(lao)(lao)(lao)(lao)動(dong)合(he)同(tong)后,在(zai)競業(ye)限(xian)制(zhi)期(qi)限(xian)內按月(yue)給予(yu)勞(lao)(lao)(lao)(lao)動(dong)者(zhe)經濟(ji)補償。勞(lao)(lao)(lao)(lao)動(dong)者(zhe)違反競業(ye)限(xian)制(zhi)約(yue)定(ding)(ding)(ding)(ding)的(de)(de),應(ying)當(dang)按照約(yue)定(ding)(ding)(ding)(ding)向用(yong)人(ren)(ren)單(dan)位(wei)(wei)支付(fu)違約(yue)金。” 所以(yi),如果他們違約(yue)了,是要交(jiao)違約(yue)金的(de)(de)。
