勞動者主動提出解除勞動合同的,還能享受經濟補償金嗎?

問(wen) 我們單位最近有些員工主動(dong)提出了解除勞動(dong)合同,請問這種情況勞動(dong)者還能享(xiang)受經(jing)濟補償(chang)嗎?

根據(ju)我國有(you)關(guan)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)法律,勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)主動(dong)(dong)(dong)(dong)(dong)提(ti)出(chu)解除勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)的不能享受(shou)經濟補(bu)償(chang)金。但是,用(yong)人(ren)單(dan)位有(you)下列情(qing)形之一,侵害勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)合(he)法權益,迫(po)使勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)提(ti)出(chu)解除勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)的,用(yong)人(ren)單(dan)位應(ying)當向勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)支付經濟補(bu)償(chang):以暴力、威(wei)脅或非法限(xian)制人(ren)身自由的手段強迫(po)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)的;未按(an)照勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)的約定支付勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)報酬(chou)或者(zhe)(zhe)提(ti)供勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)條件的;克(ke)扣或者(zhe)(zhe)拖(tuo)欠勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)工資(zi)的;拒不支付勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)延長工作(zuo)時間(jian)工資(zi)報酬(chou)的;低于當地(di)最低工資(zi)標準支付勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)工資(zi)的。
