勞動者主動提出解除勞動合同的,還能享受經濟補償金嗎?

答(da) 根據我國有關(guan)勞(lao)(lao)動(dong)(dong)(dong)(dong)法(fa)律,勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)主動(dong)(dong)(dong)(dong)提(ti)出(chu)解除(chu)勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)的(de)不能(neng)享受經濟補償(chang)金。但是,用(yong)人(ren)單(dan)位有下列情(qing)形之一,侵(qin)害勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)合(he)法(fa)權益,迫使(shi)勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)提(ti)出(chu)解除(chu)勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)的(de),用(yong)人(ren)單(dan)位應(ying)當(dang)向勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)支付經濟補償(chang):以暴力、威脅或(huo)非法(fa)限制(zhi)人(ren)身自由的(de)手段強迫勞(lao)(lao)動(dong)(dong)(dong)(dong)的(de);未按照勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)的(de)約定(ding)支付勞(lao)(lao)動(dong)(dong)(dong)(dong)報酬或(huo)者(zhe)提(ti)供勞(lao)(lao)動(dong)(dong)(dong)(dong)條件的(de);克(ke)扣或(huo)者(zhe)拖欠勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)工資(zi)的(de);拒不支付勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)延長(chang)工作時(shi)間工資(zi)報酬的(de);低于當(dang)地最低工資(zi)標準支付勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)工資(zi)的(de)。
