答 根(gen)據(ju)《勞動合(he)同(tong)(tong)法(fa)》第(di)四十一(yi)(yi)條(tiao)規(gui)定,有下列情(qing)形之(zhi)一(yi)(yi),需要裁(cai)(cai)減(jian)(jian)人(ren)員二十人(ren)以(yi)上或(huo)者(zhe)裁(cai)(cai)減(jian)(jian)不(bu)足二十人(ren)但占企(qi)業(ye)職(zhi)工(gong)(gong)總數百(bai)分(fen)之(zhi)十以(yi)上的,用人(ren)單位提前三十日向工(gong)(gong)會(hui)或(huo)者(zhe)全體職(zhi)工(gong)(gong)說明情(qing)況(kuang),聽取工(gong)(gong)會(hui)或(huo)者(zhe)職(zhi)工(gong)(gong)的意見后,裁(cai)(cai)減(jian)(jian)人(ren)員方案經(jing)向勞動行(xing)政部門報告,可以(yi)裁(cai)(cai)減(jian)(jian)人(ren)員:(一(yi)(yi))依照企(qi)業(ye)破產(chan)法(fa)規(gui)定進行(xing)重整(zheng)的;(二)生(sheng)產(chan)經(jing)營發(fa)生(sheng)嚴重困難的;(三)企(qi)業(ye)轉產(chan)、重大(da)技(ji)術革新或(huo)者(zhe)經(jing)營方式調整(zheng),經(jing)變(bian)更勞動合(he)同(tong)(tong)后,仍需裁(cai)(cai)減(jian)(jian)人(ren)員的;(四)其他因(yin)勞動合(he)同(tong)(tong)訂立時所依據(ju)的客觀經(jing)濟情(qing)況(kuang)發(fa)生(sheng)重大(da)變(bian)化(hua),致使(shi)勞動合(he)同(tong)(tong)無(wu)法(fa)履行(xing)的。
