怎樣認定成立了勞動關系啊?

我沒有(you)跟公司(si)簽訂勞(lao)動合同,想咨詢一下,怎樣(yang)認定成立了勞(lao)動關系(xi)啊?

關(guan)(guan)于(yu)事(shi)實勞(lao)(lao)動(dong)關(guan)(guan)系(xi)的認定,法律(lv)中(zhong)也有(you)相關(guan)(guan)規(gui)定。《關(guan)(guan)于(yu)確立(li)勞(lao)(lao)動(dong)關(guan)(guan)系(xi)有(you)關(guan)(guan)事(shi)項(xiang)(xiang)的通知》第二條(tiao) 用人(ren)單位未(wei)與勞(lao)(lao)動(dong)者簽訂勞(lao)(lao)動(dong)合同,認定雙方存在勞(lao)(lao)動(dong)關(guan)(guan)系(xi)時(shi)可參照(zhao)下列憑(ping)證(zheng): (一)工(gong)(gong)資(zi)支付憑(ping)證(zheng)或記(ji)錄(職工(gong)(gong)工(gong)(gong)資(zi)發放花名(ming)冊)、繳納(na)各項(xiang)(xiang)社會(hui)保險費的記(ji)錄; (二)用人(ren)單位向勞(lao)(lao)動(dong)者發放的“工(gong)(gong)作(zuo)證(zheng)”、“服務證(zheng)”等能夠證(zheng)明(ming)身份的證(zheng)件; (三)勞(lao)(lao)動(dong)者填寫的用人(ren)單位招工(gong)(gong)招聘“登記(ji)表(biao)”、“報名(ming)表(biao)”等招用記(ji)錄; (四)考勤記(ji)錄; (五(wu))其(qi)他勞(lao)(lao)動(dong)者的證(zheng)言(yan)等。搜索 其(qi)中(zhong),(一)、(三)、(四)項(xiang)(xiang)的有(you)關(guan)(guan)憑(ping)證(zheng)由用人(ren)單位負舉證(zheng)責任。
