勞動者承擔違約金的情況都有哪些?

答 用(yong)人單(dan)位(wei)與勞(lao)動(dong)(dong)者(zhe)(zhe)約(yue)(yue)(yue)定(ding)(ding)(ding)由勞(lao)動(dong)(dong)者(zhe)(zhe)承擔違約(yue)(yue)(yue)金(jin)(jin)只有兩(liang)種情況:一(yi)是(shi)(shi)用(yong)人單(dan)位(wei)為勞(lao)動(dong)(dong)者(zhe)(zhe)提(ti)供了(le)專項培訓費用(yong)培訓了(le)勞(lao)動(dong)(dong)者(zhe)(zhe),可以約(yue)(yue)(yue)定(ding)(ding)(ding)勞(lao)動(dong)(dong)者(zhe)(zhe)要完成一(yi)定(ding)(ding)(ding)的(de)服(fu)務(wu)期(qi),否則要按約(yue)(yue)(yue)定(ding)(ding)(ding)支付一(yi)定(ding)(ding)(ding)的(de)違約(yue)(yue)(yue)金(jin)(jin);二是(shi)(shi)用(yong)人單(dan)位(wei)的(de)高級(ji)管理人員(yuan)、高級(ji)技術(shu)人員(yuan)等負有保(bao)密義務(wu)的(de)人員(yuan),用(yong)人單(dan)位(wei)與勞(lao)動(dong)(dong)者(zhe)(zhe)訂(ding)立(li)有競(jing)業限制(zhi)條(tiao)款并在競(jing)業限制(zhi)期(qi)限內給予(yu)勞(lao)動(dong)(dong)者(zhe)(zhe)經濟(ji)補償的(de),勞(lao)動(dong)(dong)者(zhe)(zhe)違反競(jing)業限制(zhi)約(yue)(yue)(yue)定(ding)(ding)(ding)的(de),應當按照約(yue)(yue)(yue)定(ding)(ding)(ding)向(xiang)用(yong)人單(dan)位(wei)支付違約(yue)(yue)(yue)金(jin)(jin)。
