勞動者承擔違約金的情況都有哪些?

答(da) 用(yong)(yong)(yong)人(ren)單(dan)位與(yu)勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)約(yue)(yue)(yue)(yue)(yue)定(ding)(ding)由勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)承擔違約(yue)(yue)(yue)(yue)(yue)金(jin)只有(you)(you)兩(liang)種情況:一(yi)是用(yong)(yong)(yong)人(ren)單(dan)位為勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)提供了專項培訓費用(yong)(yong)(yong)培訓了勞(lao)動(dong)(dong)(dong)者(zhe)(zhe),可以約(yue)(yue)(yue)(yue)(yue)定(ding)(ding)勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)要完(wan)成(cheng)一(yi)定(ding)(ding)的服務(wu)(wu)期(qi),否(fou)則(ze)要按約(yue)(yue)(yue)(yue)(yue)定(ding)(ding)支付一(yi)定(ding)(ding)的違約(yue)(yue)(yue)(yue)(yue)金(jin);二是用(yong)(yong)(yong)人(ren)單(dan)位的高級(ji)管理人(ren)員、高級(ji)技術(shu)人(ren)員等負有(you)(you)保密義務(wu)(wu)的人(ren)員,用(yong)(yong)(yong)人(ren)單(dan)位與(yu)勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)訂立有(you)(you)競業(ye)限(xian)(xian)制(zhi)(zhi)條款并在競業(ye)限(xian)(xian)制(zhi)(zhi)期(qi)限(xian)(xian)內給予勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)經(jing)濟(ji)補償的,勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)違反競業(ye)限(xian)(xian)制(zhi)(zhi)約(yue)(yue)(yue)(yue)(yue)定(ding)(ding)的,應當按照約(yue)(yue)(yue)(yue)(yue)定(ding)(ding)向(xiang)用(yong)(yong)(yong)人(ren)單(dan)位支付違約(yue)(yue)(yue)(yue)(yue)金(jin)。
