未簽書面勞動合同如何確定試用期?

答(da) 在雙方未簽(qian)訂(ding)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)而又(you)無其他證(zheng)據證(zheng)明(ming)(ming)有試用(yong)(yong)期(qi)(qi)(qi)的情況下,應(ying)當認定用(yong)(yong)人單(dan)位放棄了(le)試用(yong)(yong)期(qi)(qi)(qi),雙方勞(lao)(lao)(lao)動(dong)(dong)關系中(zhong)不(bu)存在試用(yong)(yong)期(qi)(qi)(qi)問題。這就(jiu)要求用(yong)(yong)人單(dan)位通常必須在建(jian)立(li)勞(lao)(lao)(lao)動(dong)(dong)關系時就(jiu)要訂(ding)立(li)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong),或至(zhi)少就(jiu)試用(yong)(yong)期(qi)(qi)(qi)達成約(yue)(yue)定,否(fou)則此后再訂(ding)立(li)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)就(jiu)可(ke)能無法約(yue)(yue)定試用(yong)(yong)期(qi)(qi)(qi)。這樣處理顯然有利于(yu)促(cu)使用(yong)(yong)人單(dan)位簽(qian)訂(ding)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong),實(shi)現《勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)法》推(tui)進(jin)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)簽(qian)訂(ding)、規范勞(lao)(lao)(lao)動(dong)(dong)秩序的目(mu)的。至(zhi)于(yu)用(yong)(yong)人單(dan)位能證(zheng)明(ming)(ming)不(bu)簽(qian)訂(ding)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)系因勞(lao)(lao)(lao)動(dong)(dong)者原因造成的,則可(ke)依照《勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)法實(shi)施條例》,用(yong)(yong)人單(dan)位可(ke)以解除勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)。
