答 《勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)法》規(gui)定(ding):用(yong)(yong)人(ren)單(dan)位(wei)在以下三種(zhong)情形下需要向勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)支付(fu)“雙倍(bei)工(gong)資(zi)”:一(yi)(yi)是(shi)用(yong)(yong)人(ren)單(dan)位(wei)自用(yong)(yong)工(gong)之(zhi)日起超過一(yi)(yi)個月(yue)(yue)不(bu)滿一(yi)(yi)年未與(yu)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)訂立(li)書面勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)的(de),應(ying)當(dang)向勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)每月(yue)(yue)支付(fu)二(er)(er)倍(bei)的(de)工(gong)資(zi);二(er)(er)是(shi)用(yong)(yong)人(ren)單(dan)位(wei)違反(fan)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)法規(gui)定(ding)不(bu)與(yu)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)訂立(li)無(wu)固(gu)定(ding)期(qi)限勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)的(de),自應(ying)當(dang)訂立(li)無(wu)固(gu)定(ding)期(qi)限勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)之(zhi)日起向勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)每月(yue)(yue)支付(fu)二(er)(er)倍(bei)的(de)工(gong)資(zi);三是(shi)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)期(qi)滿后(hou),勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)仍在用(yong)(yong)人(ren)單(dan)位(wei)工(gong)作,用(yong)(yong)人(ren)單(dan)位(wei)超過一(yi)(yi)個月(yue)(yue)未與(yu)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)訂立(li)書面勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)的(de),應(ying)當(dang)依照《勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)法》第82條的(de)規(gui)定(ding),向勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)支付(fu)雙倍(bei)工(gong)資(zi)。
