《勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)(tong)(tong)法(fa)》規定:用(yong)人(ren)(ren)(ren)單位(wei)在以下三(san)種情形下需要向(xiang)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)支(zhi)付(fu)“雙(shuang)倍工(gong)(gong)資(zi)”:一(yi)是(shi)用(yong)人(ren)(ren)(ren)單位(wei)自用(yong)工(gong)(gong)之(zhi)日起超過(guo)一(yi)個月不(bu)(bu)滿(man)(man)一(yi)年未與勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)訂立(li)書面勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)(tong)(tong)的(de)(de)(de),應當向(xiang)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)每(mei)月支(zhi)付(fu)二倍的(de)(de)(de)工(gong)(gong)資(zi);二是(shi)用(yong)人(ren)(ren)(ren)單位(wei)違反勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)(tong)(tong)法(fa)規定不(bu)(bu)與勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)訂立(li)無固(gu)定期(qi)限勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)(tong)(tong)的(de)(de)(de),自應當訂立(li)無固(gu)定期(qi)限勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)(tong)(tong)之(zhi)日起向(xiang)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)每(mei)月支(zhi)付(fu)二倍的(de)(de)(de)工(gong)(gong)資(zi);三(san)是(shi)勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)(tong)(tong)期(qi)滿(man)(man)后,勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)仍在用(yong)人(ren)(ren)(ren)單位(wei)工(gong)(gong)作(zuo),用(yong)人(ren)(ren)(ren)單位(wei)超過(guo)一(yi)個月未與勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)訂立(li)書面勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)(tong)(tong)的(de)(de)(de),應當依照《勞(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)(tong)(tong)法(fa)》第82條的(de)(de)(de)規定,向(xiang)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)支(zhi)付(fu)雙(shuang)倍工(gong)(gong)資(zi)。
