安排員工待崗可以么?

最近公司因為經營不善(shan),想安排員工待崗,想咨(zi)詢一下(xia),現(xian)規定還有待崗規定么?

答(da) 勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)法(fa)中(zhong)并沒有“待(dai)崗”的(de)概念,所(suo)謂的(de)待(dai)崗是單位(wei)停工(gong)停產,員(yuan)工(gong)處于(yu)等待(dai)恢復生(sheng)產后(hou)上(shang)崗的(de)意思。1994年勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)部《工(gong)資(zi)支(zhi)(zhi)付(fu)(fu)暫行規(gui)(gui)定(ding)》第十二條規(gui)(gui)定(ding):“非因(yin)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者原因(yin)造(zao)成單位(wei)停工(gong)、停產在(zai)一個工(gong)資(zi)支(zhi)(zhi)付(fu)(fu)周期內的(de),用(yong)人單位(wei)應按勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同規(gui)(gui)定(ding)的(de)標(biao)準(zhun)支(zhi)(zhi)付(fu)(fu)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者工(gong)資(zi)。超過一個工(gong)資(zi)支(zhi)(zhi)付(fu)(fu)周期的(de),若勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者提供(gong)了(le)正常(chang)(chang)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong),則支(zhi)(zhi)付(fu)(fu)給勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者的(de)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)報酬不得(de)低于(yu)當地(di)的(de)最低工(gong)資(zi)標(biao)準(zhun);若勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者沒有提供(gong)正常(chang)(chang)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong),應按國家(jia)有關規(gui)(gui)定(ding)辦理。”
