最近公(gong)司整(zheng)合,把(ba)我分(fen)配到了銷售部門,想咨詢一(yi)下,遇(yu)到被公(gong)司強(qiang)行調崗(gang)怎么辦?

《勞(lao)(lao)動(dong)合同(tong)(tong)(tong)(tong)法(fa)》第三(san)十五條規定:“用(yong)人單位(wei)與勞(lao)(lao)動(dong)者(zhe)協商一致,可以(yi)變(bian)更(geng)勞(lao)(lao)動(dong)合同(tong)(tong)(tong)(tong)約定的(de)內容。變(bian)更(geng)勞(lao)(lao)動(dong)合同(tong)(tong)(tong)(tong),應當采用(yong)書面形式。”崗(gang)位(wei)是(shi)勞(lao)(lao)動(dong)合同(tong)(tong)(tong)(tong)的(de)重要條款之一。變(bian)更(geng)工作崗(gang)位(wei),屬于變(bian)更(geng)勞(lao)(lao)動(dong)合同(tong)(tong)(tong)(tong)。從這一條款看,用(yong)人單位(wei)沒(mei)有得到(dao)勞(lao)(lao)動(dong)者(zhe)的(de)同(tong)(tong)(tong)(tong)意,不能擅自(zi)調(diao)整工作崗(gang)位(wei)。
