原(yuan)(yuan)勞(lao)(lao)(lao)動(dong)部(bu)1994年發(fa)布的(de)《工(gong)(gong)(gong)資(zi)支(zhi)付(fu)暫行規(gui)(gui)定(ding)》中對(dui)企(qi)業停(ting)工(gong)(gong)(gong)、停(ting)產(chan)期(qi)間的(de)工(gong)(gong)(gong)資(zi)發(fa)放原(yuan)(yuan)則作了(le)規(gui)(gui)定(ding):“非(fei)因(yin)勞(lao)(lao)(lao)動(dong)者(zhe)原(yuan)(yuan)因(yin)造成單(dan)位停(ting)工(gong)(gong)(gong)、停(ting)產(chan)在一個工(gong)(gong)(gong)資(zi)支(zhi)付(fu)周期(qi)內的(de),用人單(dan)位應(ying)按勞(lao)(lao)(lao)動(dong)合同規(gui)(gui)定(ding)的(de)標(biao)(biao)準(zhun)支(zhi)付(fu)勞(lao)(lao)(lao)動(dong)者(zhe)工(gong)(gong)(gong)資(zi)。超過(guo)一個工(gong)(gong)(gong)資(zi)支(zhi)付(fu)周期(qi)的(de),若(ruo)勞(lao)(lao)(lao)動(dong)者(zhe)提供(gong)(gong)了(le)正常勞(lao)(lao)(lao)動(dong),則支(zhi)付(fu)給勞(lao)(lao)(lao)動(dong)者(zhe)的(de)勞(lao)(lao)(lao)動(dong)報酬不(bu)得低于當(dang)地的(de)最低工(gong)(gong)(gong)資(zi)標(biao)(biao)準(zhun);若(ruo)勞(lao)(lao)(lao)動(dong)者(zhe)沒有提供(gong)(gong)正常勞(lao)(lao)(lao)動(dong),應(ying)按國家(jia)有關規(gui)(gui)定(ding)辦理。”
