《勞(lao)(lao)動(dong)合(he)同法》對競(jing)業(ye)禁止適(shi)用(yong)(yong)范圍、期限(xian)(xian)以及補(bu)償(chang)方式均作(zuo)出了明確規(gui)定(ding),第23條規(gui)定(ding):“用(yong)(yong)人單位與(yu)(yu)勞(lao)(lao)動(dong)者(zhe)可(ke)(ke)以在(zai)(zai)勞(lao)(lao)動(dong)合(he)同中約定(ding)保守(shou)用(yong)(yong)人單位的商業(ye)秘密(mi) 和與(yu)(yu)知識產(chan)權(quan)相關的保密(mi)事項。對負有保密(mi)義務(wu)的勞(lao)(lao)動(dong)者(zhe),用(yong)(yong)人單位可(ke)(ke)以在(zai)(zai)勞(lao)(lao)動(dong)合(he)同或者(zhe)保密(mi)協議中與(yu)(yu)勞(lao)(lao)動(dong)者(zhe)約定(ding)競(jing)業(ye)限(xian)(xian)制(zhi)條款,并約定(ding)在(zai)(zai)解除或者(zhe)終止勞(lao)(lao)動(dong)合(he)同后,在(zai)(zai)競(jing)業(ye)限(xian)(xian)制(zhi)期限(xian)(xian)內(nei)按月給予勞(lao)(lao)動(dong)者(zhe)經濟補(bu)償(chang)。勞(lao)(lao)動(dong)者(zhe)違(wei)反競(jing)業(ye)限(xian)(xian)制(zhi)約定(ding)的,應當(dang)按照約定(ding)向用(yong)(yong)人單位支付違(wei)約金。”
