最近剛(gang)應聘了(le)一(yi)家新(xin)公司,想咨詢一(yi)下,對于競(jing)業禁止適(shi)用范圍(wei)有哪些(xie)規定(ding)啊?

《勞(lao)(lao)動(dong)合(he)同法》對競(jing)(jing)業(ye)禁止適(shi)用(yong)范圍(wei)、期(qi)限(xian)(xian)(xian)以(yi)及補償方式(shi)均作出了明確規定(ding)(ding),第23條規定(ding)(ding):“用(yong)人(ren)(ren)單(dan)(dan)位與勞(lao)(lao)動(dong)者(zhe)(zhe)可以(yi)在勞(lao)(lao)動(dong)合(he)同中約(yue)定(ding)(ding)保(bao)守(shou)用(yong)人(ren)(ren)單(dan)(dan)位的(de)(de)商業(ye)秘密(mi) 和(he)與知識產權(quan)相關的(de)(de)保(bao)密(mi)事(shi)項(xiang)。對負有保(bao)密(mi)義務的(de)(de)勞(lao)(lao)動(dong)者(zhe)(zhe),用(yong)人(ren)(ren)單(dan)(dan)位可以(yi)在勞(lao)(lao)動(dong)合(he)同或(huo)者(zhe)(zhe)保(bao)密(mi)協(xie)議中與勞(lao)(lao)動(dong)者(zhe)(zhe)約(yue)定(ding)(ding)競(jing)(jing)業(ye)限(xian)(xian)(xian)制(zhi)條款,并約(yue)定(ding)(ding)在解除或(huo)者(zhe)(zhe)終止勞(lao)(lao)動(dong)合(he)同后,在競(jing)(jing)業(ye)限(xian)(xian)(xian)制(zhi)期(qi)限(xian)(xian)(xian)內(nei)按月給予勞(lao)(lao)動(dong)者(zhe)(zhe)經濟補償。勞(lao)(lao)動(dong)者(zhe)(zhe)違(wei)反競(jing)(jing)業(ye)限(xian)(xian)(xian)制(zhi)約(yue)定(ding)(ding)的(de)(de),應當按照約(yue)定(ding)(ding)向用(yong)人(ren)(ren)單(dan)(dan)位支付違(wei)約(yue)金。”
