無故拖欠工資應承擔什么法律后果呢?

答 用人(ren)單位有下列侵害(hai)勞(lao)動(dong)者(zhe)合(he)法(fa)權(quan)益情形之一的(de)(de)(de),由勞(lao)動(dong)行(xing)政部(bu)門責令支(zhi)付勞(lao)動(dong)者(zhe)的(de)(de)(de)工(gong)(gong)資(zi)(zi)(zi)報酬(chou)、經濟補償(chang),并可(ke)以責令支(zhi)付賠償(chang)金: (1)克扣或者(zhe)無(wu)故(gu)拖欠勞(lao)動(dong)者(zhe)工(gong)(gong)資(zi)(zi)(zi)的(de)(de)(de); (2)拒不支(zhi)付勞(lao)動(dong)者(zhe)延長(chang)工(gong)(gong)作時間工(gong)(gong)資(zi)(zi)(zi)報酬(chou)的(de)(de)(de); (3)低(di)于當地(di)最低(di)工(gong)(gong)資(zi)(zi)(zi)標(biao)準支(zhi)付勞(lao)動(dong)者(zhe)工(gong)(gong)資(zi)(zi)(zi)的(de)(de)(de); (4)解除勞(lao)動(dong)合(he)同(tong)后,未依照本法(fa)規定給(gei)予勞(lao)動(dong)者(zhe)經濟補償(chang)的(de)(de)(de)。” 可(ke)以看出對于無(wu)故(gu)拖欠職工(gong)(gong)工(gong)(gong)資(zi)(zi)(zi)的(de)(de)(de)行(xing)為應由資(zi)(zi)(zi)方支(zhi)付拖欠工(gong)(gong)資(zi)(zi)(zi)、補償(chang)金(25%拖欠工(gong)(gong)資(zi)(zi)(zi)額),必要時還要支(zhi)付賠償(chang)金(但要以造成實際損(sun)害(hai)為前提)。
