試用期員工不認證工作怎么辦?

答 《勞(lao)(lao)動(dong)(dong)(dong)合同法》第四十條規定,勞(lao)(lao)動(dong)(dong)(dong)者(zhe)不能勝任工(gong)作,經(jing)過培(pei)(pei)訓或者(zhe)調整工(gong)作崗位,仍不能勝任工(gong)作的,用(yong)人(ren)單位提前三十日以書面形式(shi)通(tong)知(zhi)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)本人(ren)或者(zhe)額(e)外支付勞(lao)(lao)動(dong)(dong)(dong)者(zhe)一個月工(gong)資后(hou),可以解(jie)除勞(lao)(lao)動(dong)(dong)(dong)合同。這(zhe)種解(jie)除方式(shi)需要用(yong)人(ren)單位提供充分的前后(hou)兩次不勝任的證(zheng)據,以及(ji)培(pei)(pei)訓和調整工(gong)作崗位的證(zheng)明。同時,單位需要依(yi)法支付經(jing)濟補(bu)償金。
