答 根據我國勞(lao)(lao)動(dong)合同法規(gui)定(ding),非(fei)全日制用(yong)工(gong)(gong),是指以小時(shi)(shi)計酬為主(zhu),勞(lao)(lao)動(dong)者(zhe)(zhe)在同一(yi)用(yong)人單位(wei)一(yi)般平均每日工(gong)(gong)作時(shi)(shi)間不(bu)超(chao)過四小時(shi)(shi),每周工(gong)(gong)作時(shi)(shi)間累計不(bu)超(chao)過二十四小時(shi)(shi)的用(yong)工(gong)(gong)形(xing)式。非(fei)全日制用(yong)工(gong)(gong)雙方(fang)當事人任(ren)何一(yi)方(fang)都可以隨時(shi)(shi)通(tong)知對方(fang)終止用(yong)功。終止用(yong)工(gong)(gong),用(yong)人單位(wei)不(bu)向勞(lao)(lao)動(dong)者(zhe)(zhe)支付經濟賠償(chang)。但(dan)需注(zhu)意一(yi)點就是勞(lao)(lao)務(wu)派(pai)遣單位(wei)不(bu)得以非(fei)全日制用(yong)工(gong)(gong)形(xing)式招用(yong)被派(pai)遣勞(lao)(lao)動(dong)者(zhe)(zhe)。
