首(shou)先(xian)照(zhao)《中華人(ren)民(min)共和國勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)爭(zheng)議(yi)(yi)(yi)仲裁(cai)(cai)法(fa)》規定(ding),勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)爭(zheng)議(yi)(yi)(yi)仲裁(cai)(cai)委員會受理下列(lie)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)爭(zheng)議(yi)(yi)(yi):因(yin)(yin)訂立、履行、變更、解除和終止(zhi)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)發(fa)生(sheng)的(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)爭(zheng)議(yi)(yi)(yi);因(yin)(yin)除名、辭退和辭職、離職發(fa)生(sheng)的(de)爭(zheng)議(yi)(yi)(yi);因(yin)(yin)工作時(shi)間、休息休假、社會保(bao)險、福利、培(pei)訓以及勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)保(bao)護(hu)發(fa)生(sheng)的(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)爭(zheng)議(yi)(yi)(yi);因(yin)(yin)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)報酬、工傷醫療費、經濟補償(chang)或(huo)者賠償(chang)金(jin)及確認勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關系等發(fa)生(sheng)的(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)爭(zheng)議(yi)(yi)(yi)及法(fa)律法(fa)規規定(ding)的(de)其他勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)爭(zheng)議(yi)(yi)(yi)。其次(ci)申請勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)仲裁(cai)(cai)的(de)當事人(ren)應(ying)當在勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)爭(zheng)議(yi)(yi)(yi)仲裁(cai)(cai)時(shi)效范圍(wei)內申請勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)仲裁(cai)(cai),如(ru)果過(guo)了(le)(le)時(shi)效申請,就喪失(shi)了(le)(le)勝(sheng)(sheng)訴(su)(su)權(quan),即證據(ju)充分勝(sheng)(sheng)訴(su)(su)把握很大的(de)一個案子(zi),因(yin)(yin)超過(guo)仲裁(cai)(cai)時(shi)效,就喪失(shi)了(le)(le)勝(sheng)(sheng)訴(su)(su)權(quan)。最后當事人(ren)應(ying)向有管轄權(quan)的(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)爭(zheng)議(yi)(yi)(yi)仲裁(cai)(cai)委員會申請仲裁(cai)(cai)。
