未簽訂勞動合同被迫解除勞動關系怎么辦?

答 建立勞(lao)(lao)(lao)動(dong)(dong)(dong)關系,應當簽訂勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)。《勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)法(fa)》第(di)八十二條(tiao)規定(ding):用(yong)(yong)人(ren)單位自用(yong)(yong)工之(zhi)日起超過一個月(yue)不滿一年未與(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)訂立書面(mian)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)的,應當向勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)每月(yue)支付(fu)(fu)2倍工資。用(yong)(yong)人(ren)單位違反本(ben)法(fa)規定(ding)不與(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)訂立無固定(ding)期(qi)限勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)的,自應當訂立無固定(ding)期(qi)限勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)之(zhi)日起向勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)每月(yue)支付(fu)(fu)二倍的工資。《勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)法(fa)》第(di)85條(tiao)規定(ding),未按(an)(an)照國家規定(ding)及時足額支付(fu)(fu)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)勞(lao)(lao)(lao)動(dong)(dong)(dong)報酬的,由勞(lao)(lao)(lao)動(dong)(dong)(dong)行(xing)政部(bu)門責令限期(qi)支付(fu)(fu)勞(lao)(lao)(lao)動(dong)(dong)(dong)報酬,逾期(qi)不支付(fu)(fu)的,責令用(yong)(yong)人(ren)單位按(an)(an)應付(fu)(fu)金(jin)額50%以上100%以下的標(biao)準(zhun)向勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)加付(fu)(fu)賠償金(jin)。
