補休都可以代替加班工資嗎?

最近由于公司(si)的業務很忙,公司(si)組織大(da)家(jia)加了一次班(ban),所有(you)補休都可以代替加班(ban)工資(zi)嗎?

答(da) 并(bing)不是所有的補(bu)休(xiu)(xiu)都能代替加(jia)班(ban)工(gong)(gong)資(zi),要視(shi)具體情況(kuang)而定。 如(ru)果用人單位(wei)安(an)排勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)在公休(xiu)(xiu)日加(jia)班(ban),又能安(an)排補(bu)休(xiu)(xiu)的,則這時的補(bu)休(xiu)(xiu)能代替加(jia)班(ban)工(gong)(gong)資(zi),在對勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)安(an)排了補(bu)休(xiu)(xiu)之后,用人單位(wei)不用再向勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)支付加(jia)班(ban)工(gong)(gong)資(zi);如(ru)果用人單位(wei)安(an)排勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)在法(fa)定節假日加(jia)班(ban),即使能夠安(an)排勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)補(bu)休(xiu)(xiu),也要向勞(lao)(lao)動(dong)(dong)(dong)者(zhe)(zhe)支付加(jia)班(ban)工(gong)(gong)資(zi),即這時的補(bu)休(xiu)(xiu)不能代替加(jia)班(ban)工(gong)(gong)資(zi)。
