《勞(lao)(lao)動(dong)合同(tong)(tong)(tong)法》第(di)8條規(gui)定:“用人(ren)單位(wei)有(you)(you)權了解勞(lao)(lao)動(dong)者(zhe)(zhe)與勞(lao)(lao)動(dong)合同(tong)(tong)(tong)直(zhi)接相關的(de)基(ji)本(ben)情況(kuang),勞(lao)(lao)動(dong)者(zhe)(zhe)應(ying)當如(ru)實說(shuo)明”。這就(jiu)是說(shuo),在面試或者(zhe)(zhe)訂立勞(lao)(lao)動(dong)合同(tong)(tong)(tong)時(shi),求職者(zhe)(zhe)對與勞(lao)(lao)動(dong)合同(tong)(tong)(tong)直(zhi)接相關的(de)基(ji)本(ben)情況(kuang)具(ju)有(you)(you)告知(zhi)(zhi)義務,用人(ren)單位(wei)享有(you)(you)知(zhi)(zhi)情權。
