公司扣押員工的身份證合適嗎?

我是一名(ming)應屆畢(bi)業生,現在(zai)正(zheng)在(zai)濟南工作(zuo),想知(zhi)道(dao)單位扣(kou)押員工的身份證合適嗎?

根據規(gui)定(ding),用人(ren)單(dan)位(wei)(wei)違反《勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同法(fa)》規(gui)定(ding),扣(kou)押(ya)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)居民身份證等證件的,由(you)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)行(xing)政(zheng)部門責(ze)(ze)令限(xian)期退(tui)還勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)本(ben)人(ren),并依(yi)(yi)照有關法(fa)律(lv)規(gui)定(ding)給予處(chu)罰。 另外,如果用人(ren)單(dan)位(wei)(wei)以(yi)擔(dan)保或(huo)者(zhe)(zhe)其(qi)(qi)他名義向勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)收取(qu)財物的,由(you)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)行(xing)政(zheng)部門責(ze)(ze)令限(xian)期退(tui)還勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)本(ben)人(ren),并以(yi)每人(ren)500元以(yi)上2000元以(yi)下(xia)的標(biao)準(zhun)處(chu)以(yi)罰款(kuan)(kuan);給勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)造成損害的,應當承擔(dan)賠償責(ze)(ze)任。 勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)依(yi)(yi)法(fa)解除或(huo)者(zhe)(zhe)終止勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同時,用人(ren)單(dan)位(wei)(wei)扣(kou)押(ya)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)檔案或(huo)者(zhe)(zhe)其(qi)(qi)他物品的,依(yi)(yi)照前款(kuan)(kuan)規(gui)定(ding)處(chu)罰。
