離職時年假工資怎么算?

我(wo)要離職(zhi)了(le),但是我(wo)還有(you)4天的年假沒有(you)休,聽(ting)說會給予(yu)工(gong)(gong)資補償(chang),那離職(zhi)年假的工(gong)(gong)資怎么算呢?

用人單位與職(zhi)工(gong)解(jie)除(chu)或者(zhe)終止(zhi)勞(lao)動(dong)合同時,未安(an)排(pai)職(zhi)工(gong)休(xiu)(xiu)(xiu)(xiu)滿應(ying)(ying)休(xiu)(xiu)(xiu)(xiu)年(nian)休(xiu)(xiu)(xiu)(xiu)假(jia)(jia)的,應(ying)(ying)當(dang)(dang)按照職(zhi)工(gong)當(dang)(dang)年(nian)已工(gong)作(zuo)時間折(zhe)算(suan)應(ying)(ying)休(xiu)(xiu)(xiu)(xiu)未休(xiu)(xiu)(xiu)(xiu)年(nian)休(xiu)(xiu)(xiu)(xiu)假(jia)(jia)天(tian)(tian)數(shu)并支付未休(xiu)(xiu)(xiu)(xiu)年(nian)休(xiu)(xiu)(xiu)(xiu)假(jia)(jia)工(gong)資(zi)報(bao)(bao)酬(chou),但折(zhe)算(suan)后(hou)不足1整天(tian)(tian)的部分不支付未休(xiu)(xiu)(xiu)(xiu)年(nian)休(xiu)(xiu)(xiu)(xiu)假(jia)(jia)工(gong)資(zi)報(bao)(bao)酬(chou)。 折(zhe)算(suan)方法(fa)為:(當(dang)(dang)年(nian)度在(zai)本單位已過日歷天(tian)(tian)數(shu)÷365天(tian)(tian))×職(zhi)工(gong)本人全年(nian)應(ying)(ying)當(dang)(dang)享受的年(nian)休(xiu)(xiu)(xiu)(xiu)假(jia)(jia)天(tian)(tian)數(shu)-當(dang)(dang)年(nian)度已安(an)排(pai)年(nian)休(xiu)(xiu)(xiu)(xiu)假(jia)(jia)天(tian)(tian)數(shu)。 用人單位當(dang)(dang)年(nian)已安(an)排(pai)職(zhi)工(gong)年(nian)休(xiu)(xiu)(xiu)(xiu)假(jia)(jia)的,多(duo)于(yu)折(zhe)算(suan)應(ying)(ying)休(xiu)(xiu)(xiu)(xiu)年(nian)休(xiu)(xiu)(xiu)(xiu)假(jia)(jia)的天(tian)(tian)數(shu)不再扣回(hui)。
