公司不與勞動者簽訂書面勞動合同,會受到什么懲罰?

答 《勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)法(fa)》規(gui)定(ding),用人單位自用工之日起超過一個月(yue)不(bu)滿(man)一年未與勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者訂(ding)(ding)立(li)(li)書(shu)面勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)的,應(ying)當(dang)向(xiang)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者每月(yue)支(zhi)(zhi)付(fu)(fu)二倍(bei)(bei)的工資(zi)(zi);用人單位違反本法(fa)規(gui)定(ding)不(bu)與勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者訂(ding)(ding)立(li)(li)無固定(ding)期限(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)的,自應(ying)當(dang)訂(ding)(ding)立(li)(li)無固定(ding)期限(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong)之日起向(xiang)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者每月(yue)支(zhi)(zhi)付(fu)(fu)二倍(bei)(bei)的工資(zi)(zi)。因此,單位如果未依法(fa)與勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者訂(ding)(ding)立(li)(li)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)(tong)(tong),除應(ying)向(xiang)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者支(zhi)(zhi)付(fu)(fu)其(qi)應(ying)得的工資(zi)(zi)以外(wai),還需再支(zhi)(zhi)付(fu)(fu)一倍(bei)(bei)的工資(zi)(zi)作為對(dui)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者的補償(chang)。
