公司不與勞動者簽訂書面勞動合同,會受到什么懲罰?

答 《勞(lao)(lao)(lao)動(dong)(dong)合同法》規定,用(yong)人單(dan)(dan)位(wei)自(zi)用(yong)工(gong)之(zhi)(zhi)日起超過一個(ge)月(yue)不滿一年未與勞(lao)(lao)(lao)動(dong)(dong)者訂(ding)立(li)書面勞(lao)(lao)(lao)動(dong)(dong)合同的(de),應(ying)當(dang)向(xiang)勞(lao)(lao)(lao)動(dong)(dong)者每月(yue)支付二(er)倍的(de)工(gong)資;用(yong)人單(dan)(dan)位(wei)違反本(ben)法規定不與勞(lao)(lao)(lao)動(dong)(dong)者訂(ding)立(li)無固定期(qi)限勞(lao)(lao)(lao)動(dong)(dong)合同的(de),自(zi)應(ying)當(dang)訂(ding)立(li)無固定期(qi)限勞(lao)(lao)(lao)動(dong)(dong)合同之(zhi)(zhi)日起向(xiang)勞(lao)(lao)(lao)動(dong)(dong)者每月(yue)支付二(er)倍的(de)工(gong)資。因此,單(dan)(dan)位(wei)如果未依(yi)法與勞(lao)(lao)(lao)動(dong)(dong)者訂(ding)立(li)勞(lao)(lao)(lao)動(dong)(dong)合同,除應(ying)向(xiang)勞(lao)(lao)(lao)動(dong)(dong)者支付其(qi)應(ying)得的(de)工(gong)資以外(wai),還需(xu)再支付一倍的(de)工(gong)資作為(wei)對勞(lao)(lao)(lao)動(dong)(dong)者的(de)補償。
