公司不與勞動者簽訂書面勞動合同,會受到什么懲罰?

答(da) 《勞(lao)(lao)動(dong)(dong)合(he)(he)同法》規定(ding),用人單位(wei)自用工(gong)之(zhi)日(ri)起超過一個月不(bu)滿一年未與勞(lao)(lao)動(dong)(dong)者(zhe)訂立書面(mian)勞(lao)(lao)動(dong)(dong)合(he)(he)同的(de),應(ying)(ying)當向(xiang)勞(lao)(lao)動(dong)(dong)者(zhe)每月支(zhi)付二(er)倍(bei)的(de)工(gong)資;用人單位(wei)違反本法規定(ding)不(bu)與勞(lao)(lao)動(dong)(dong)者(zhe)訂立無固(gu)定(ding)期限勞(lao)(lao)動(dong)(dong)合(he)(he)同的(de),自應(ying)(ying)當訂立無固(gu)定(ding)期限勞(lao)(lao)動(dong)(dong)合(he)(he)同之(zhi)日(ri)起向(xiang)勞(lao)(lao)動(dong)(dong)者(zhe)每月支(zhi)付二(er)倍(bei)的(de)工(gong)資。因此,單位(wei)如(ru)果未依法與勞(lao)(lao)動(dong)(dong)者(zhe)訂立勞(lao)(lao)動(dong)(dong)合(he)(he)同,除應(ying)(ying)向(xiang)勞(lao)(lao)動(dong)(dong)者(zhe)支(zhi)付其應(ying)(ying)得的(de)工(gong)資以外,還需再支(zhi)付一倍(bei)的(de)工(gong)資作為(wei)對勞(lao)(lao)動(dong)(dong)者(zhe)的(de)補償。
