什么情況下用人單位應當支付被辭退員工補償金?

一個朋友(you)被公司(si)辭退(tui)了,但是公司(si)也沒有給(gei)補償,在什么情(qing)況下(xia)用人單位應當支付被辭退(tui)員(yuan)工補償金?

根據《勞動(dong)合(he)同(tong)法(fa)(fa)》規(gui)定,有下列情形(xing)之一(yi)的(de),用(yong)(yong)(yong)人單(dan)(dan)(dan)位應當(dang)支付被(bei)辭(ci)(ci)退員(yuan)工(gong)(gong)補償(chang)金(jin): (一(yi))用(yong)(yong)(yong)人單(dan)(dan)(dan)位依照企業破(po)(po)產法(fa)(fa)規(gui)定進行重(zhong)整,經過合(he)法(fa)(fa)程序辭(ci)(ci)退員(yuan)工(gong)(gong)的(de); (二)勞動(dong)合(he)同(tong)期滿后用(yong)(yong)(yong)人單(dan)(dan)(dan)位決定不與員(yuan)工(gong)(gong)續簽的(de),但(dan)用(yong)(yong)(yong)人單(dan)(dan)(dan)位維(wei)持或者提高勞動(dong)合(he)同(tong)約定條件續訂(ding)勞動(dong)合(he)同(tong),勞動(dong)者不同(tong)意續訂(ding)的(de)情形(xing)除(chu)外; (三)用(yong)(yong)(yong)人單(dan)(dan)(dan)位被(bei)依法(fa)(fa)宣告破(po)(po)產或用(yong)(yong)(yong)人單(dan)(dan)(dan)位被(bei)吊銷營業執照、責令關閉、撤銷時辭(ci)(ci)退員(yuan)工(gong)(gong)的(de); (四)用(yong)(yong)(yong)人單(dan)(dan)(dan)位決定提前解散時辭(ci)(ci)退員(yuan)工(gong)(gong)的(de)。 需提前30日通知(zhi)或支付代(dai)通知(zhi)金(jin)作為補償(chang)的(de)情形(xing)。
