員工不簽合同單位需要支付補償嗎?
問 我是企(qi)業人(ren)事,上月招用(yong)(yong)了一位(wei)員工(gong)(gong),幾次提供勞動(dong)合同文(wen)本給這(zhe)位(wei)員工(gong)(gong)簽訂都被拒絕,那么這(zhe)種情況(kuang)下,單位(wei)終止用(yong)(yong)工(gong)(gong)需要支(zhi)付經(jing)濟補(bu)償嗎(ma)?
答 根據(ju)《中華人(ren)(ren)民共和國勞(lao)(lao)動(dong)(dong)合同(tong)法實(shi)施條例(li)》:自用(yong)工之日起一(yi)個月內,經用(yong)人(ren)(ren)單(dan)位書(shu)面通知后(hou),勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)不與用(yong)人(ren)(ren)單(dan)位訂立書(shu)面勞(lao)(lao)動(dong)(dong)合同(tong)的(de),用(yong)人(ren)(ren)單(dan)位應當書(shu)面通知勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)終(zhong)止勞(lao)(lao)動(dong)(dong)關系,無需向(xiang)勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)支(zhi)付經濟補(bu)償,但是應當依法向(xiang)勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)支(zhi)付其實(shi)際工作時間的(de)勞(lao)(lao)動(dong)(dong)報酬。
