員工不簽合同單位需要支付補償嗎?
問 我是企業人事,上月招用(yong)了一(yi)位員(yuan)工,幾次提供勞動合(he)同文本給這位員(yuan)工簽(qian)訂都被拒絕(jue),那(nei)么這種情況下,單位終止用(yong)工需要(yao)支付(fu)經濟(ji)補償嗎?
答 根(gen)據《中(zhong)華(hua)人民共(gong)和國勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)法(fa)實施條例(li)》:自用(yong)工(gong)(gong)之日起一個月內(nei),經用(yong)人單(dan)(dan)位書面(mian)通知后(hou),勞(lao)(lao)動(dong)(dong)(dong)(dong)者不與用(yong)人單(dan)(dan)位訂(ding)立書面(mian)勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)的,用(yong)人單(dan)(dan)位應當書面(mian)通知勞(lao)(lao)動(dong)(dong)(dong)(dong)者終(zhong)止勞(lao)(lao)動(dong)(dong)(dong)(dong)關系,無需向勞(lao)(lao)動(dong)(dong)(dong)(dong)者支(zhi)付經濟補償,但是應當依(yi)法(fa)向勞(lao)(lao)動(dong)(dong)(dong)(dong)者支(zhi)付其實際工(gong)(gong)作時(shi)間的勞(lao)(lao)動(dong)(dong)(dong)(dong)報酬(chou)。
