從市(shi)人社局獲悉(xi),為貫徹執(zhi)行《職工(gong)帶(dai)薪年休(xiu)(xiu)假條(tiao)例》,根據上級(ji)有關(guan)文件精神,市(shi)政府(fu)辦公(gong)室近日印發(fa)了《關(guan)于進一步落實(shi)機(ji)關(guan)事業(ye)單(dan)位工(gong)作人員(yuan)(yuan)帶(dai)薪年休(xiu)(xiu)假制(zhi)度(du)的意見的通知》,要(yao)求(qiu)各級(ji)領導(dao)干(gan)部特別是主要(yao)負責同志要(yao)帶(dai)頭執(zhi)行帶(dai)薪年休(xiu)(xiu)假制(zhi)度(du),我市(shi)機(ji)關(guan)事業(ye)單(dan)位工(gong)作人員(yuan)(yuan)帶(dai)薪年休(xiu)(xiu)假制(zhi)度(du)全面推(tui)行。
據了解,《通知(zhi)》要(yao)求,全市各(ge)級機(ji)關(guan)事業單(dan)位在充分(fen)考慮干(gan)部職工(gong)意愿(yuan)的基(ji)礎上,結合單(dan)位工(gong)作(zuo)(zuo)計(ji)(ji)劃統籌安(an)排(pai),于每年(nian)(nian)3月底前制定(ding)本單(dan)位全體工(gong)作(zuo)(zuo)人員(yuan)年(nian)(nian)休假(jia)計(ji)(ji)劃,報同級人力資源社會保障、財(cai)政部門備案(an)。要(yao)積極研(yan)究推動年(nian)(nian)休假(jia)計(ji)(ji)劃的落實措(cuo)施(shi),全面推行(xing)“A、B角”工(gong)作(zuo)(zuo)制度(du)(A角對某項(xiang)工(gong)作(zuo)(zuo)主要(yao)負責(ze),B角應主動熟悉并(bing)協助做好該項(xiang)工(gong)作(zuo)(zuo),當(dang)A角出(chu)差(cha)或休假(jia)等原因不能承(cheng)擔完成該項(xiang)工(gong)作(zuo)(zuo)時(shi),由B角接(jie)替(ti)完成該項(xiang)工(gong)作(zuo)(zuo),并(bing)切實負起責(ze)任,反之亦然;A、B兩個責(ze)任人不得(de)同時(shi)外出(chu)),完善考勤和(he)請(qing)銷假(jia)制度(du),定(ding)期公布(bu)本單(dan)位年(nian)(nian)休假(jia)計(ji)(ji)劃執行(xing)和(he)調休情(qing)況,接(jie)受本單(dan)位干(gan)部職工(gong)和(he)群眾(zhong)監督。
《通知(zhi)》同時強(qiang)調,各級各部門(men)(men)要建(jian)立涵蓋(gai)本單位全體人員的年(nian)休(xiu)(xiu)(xiu)(xiu)假計劃(hua)臺賬,對確(que)因工作需要不能按計劃(hua)休(xiu)(xiu)(xiu)(xiu)假的,要經本單位或主管(guan)部門(men)(men)組織人事(shi)部門(men)(men)同意,經過2次調休(xiu)(xiu)(xiu)(xiu)后仍(reng)無法在當年(nian)休(xiu)(xiu)(xiu)(xiu)假的,方可(ke)認定為符合(he)“確(que)因工作需要不安排(pai)休(xiu)(xiu)(xiu)(xiu)假”的條件,可(ke)申請發放年(nian)休(xiu)(xiu)(xiu)(xiu)假工資報酬。
根據《職(zhi)(zhi)工(gong)(gong)(gong)帶(dai)薪年休(xiu)(xiu)(xiu)(xiu)(xiu)假(jia)條(tiao)例(li)》,單(dan)位確因工(gong)(gong)(gong)作需要不能(neng)安(an)排(pai)職(zhi)(zhi)工(gong)(gong)(gong)休(xiu)(xiu)(xiu)(xiu)(xiu)年休(xiu)(xiu)(xiu)(xiu)(xiu)假(jia)的(de)(de),經職(zhi)(zhi)工(gong)(gong)(gong)本(ben)人同意,可以(yi)不安(an)排(pai)職(zhi)(zhi)工(gong)(gong)(gong)休(xiu)(xiu)(xiu)(xiu)(xiu)年休(xiu)(xiu)(xiu)(xiu)(xiu)假(jia)。對職(zhi)(zhi)工(gong)(gong)(gong)應休(xiu)(xiu)(xiu)(xiu)(xiu)未休(xiu)(xiu)(xiu)(xiu)(xiu)的(de)(de)年休(xiu)(xiu)(xiu)(xiu)(xiu)假(jia)天(tian)數,單(dan)位應當按(an)照該職(zhi)(zhi)工(gong)(gong)(gong)日工(gong)(gong)(gong)資(zi)收入的(de)(de)300%支付年休(xiu)(xiu)(xiu)(xiu)(xiu)假(jia)工(gong)(gong)(gong)資(zi)報酬。
單(dan)(dan)位不安排職(zhi)工(gong)(gong)休年(nian)(nian)休假又不依照(zhao)(zhao)(zhao)《職(zhi)工(gong)(gong)帶(dai)薪年(nian)(nian)休假條例》規定給予(yu)年(nian)(nian)休假工(gong)(gong)資(zi)報酬的(de),由縣級(ji)以上地(di)方人民政府(fu)人事部(bu)門或(huo)者(zhe)勞(lao)動保障部(bu)門依據(ju)職(zhi)權責(ze)(ze)令限期改正(zheng);對(dui)逾期不改正(zheng)的(de),除責(ze)(ze)令該單(dan)(dan)位支(zhi)付(fu)年(nian)(nian)休假工(gong)(gong)資(zi)報酬外,單(dan)(dan)位還應(ying)當按照(zhao)(zhao)(zhao)年(nian)(nian)休假工(gong)(gong)資(zi)報酬的(de)數額向(xiang)職(zhi)工(gong)(gong)加付(fu)賠償金(jin);對(dui)拒不支(zhi)付(fu)年(nian)(nian)休假工(gong)(gong)資(zi)報酬、賠償金(jin)的(de),屬(shu)(shu)于公務(wu)員(yuan)和參照(zhao)(zhao)(zhao)公務(wu)員(yuan)法管理的(de)人員(yuan)所在單(dan)(dan)位的(de),對(dui)直接負責(ze)(ze)的(de)主(zhu)管人員(yuan)以及其他直接責(ze)(ze)任人員(yuan)依法給予(yu)處分;屬(shu)(shu)于其他單(dan)(dan)位的(de),由勞(lao)動保障部(bu)門、人事部(bu)門或(huo)者(zhe)職(zhi)工(gong)(gong)申請(qing)人民法院(yuan)強制執(zhi)行(xing)。
此外,職工(gong)(gong)具有依法享受寒暑(shu)假(jia)(jia)(jia)(jia)(jia),其休假(jia)(jia)(jia)(jia)(jia)天(tian)數(shu)多于年(nian)休假(jia)(jia)(jia)(jia)(jia)天(tian)數(shu)的(de);請事假(jia)(jia)(jia)(jia)(jia)累(lei)計20天(tian)以(yi)上(shang)且單(dan)位按照規定不(bu)扣(kou)工(gong)(gong)資的(de);累(lei)計工(gong)(gong)作(zuo)滿1年(nian)不(bu)滿10年(nian),請病假(jia)(jia)(jia)(jia)(jia)累(lei)計2個月(yue)以(yi)上(shang);累(lei)計工(gong)(gong)作(zuo)滿10年(nian)不(bu)滿20年(nian),請病假(jia)(jia)(jia)(jia)(jia)累(lei)計3個月(yue)以(yi)上(shang);累(lei)計工(gong)(gong)作(zuo)滿20年(nian)以(yi)上(shang),請病假(jia)(jia)(jia)(jia)(jia)累(lei)計4個月(yue)以(yi)上(shang)等五個情(qing)形(xing)之(zhi)一的(de),不(bu)享受當年(nian)的(de)年(nian)休假(jia)(jia)(jia)(jia)(jia)。
