超過1年時限是否還可認定工傷

某市(shi)機械設備有(you)限公司(si)職工(gong)張(zhang)(zhang)某在(zai)工(gong)作中突感不(bu)適(shi),送醫(yi)院搶(qiang)救(jiu)無效(xiao)后死(si)亡。因張(zhang)(zhang)某與(yu)單位是否存在(zai)勞(lao)動關系(xi)發(fa)生爭議(yi),經過了(le)勞(lao)動仲(zhong)裁(cai)、一(yi)審、二審等法(fa)律程(cheng)序(xu),兩年后法(fa)院最(zui)終確認張(zhang)(zhang)某與(yu)該單位存在(zai)勞(lao)動關系(xi)。確認勞(lao)動關系(xi)后,申(shen)請人到當地工(gong)傷(shang)認定機構(gou)申(shen)請工(gong)傷(shang)認定,當地工(gong)傷(shang)認定部(bu)門以超(chao)過1年時限為(wei)由做出了(le)不(bu)予工(gong)傷(shang)受理決定。

張某(mou)家(jia)屬(shu)不(bu)服(fu),向上級(ji)機(ji)(ji)關提起行(xing)政(zheng)復議申請。上級(ji)機(ji)(ji)關認(ren)(ren)為(wei):因(yin)用人單位(wei)不(bu)承認(ren)(ren)與(yu)張某(mou)的(de)(de)勞動(dong)關系(xi)(xi),張某(mou)家(jia)屬(shu)不(bu)得不(bu)通過法律途徑(jing)確認(ren)(ren)勞動(dong)關系(xi)(xi),其(qi)最(zui)終目(mu)的(de)(de)就(jiu)是為(wei)了(le)能夠(gou)順(shun)利申報工(gong)傷。因(yin)此,其(qi)要求確定(ding)(ding)(ding)勞動(dong)關系(xi)(xi)行(xing)為(wei)與(yu)其(qi)主張工(gong)傷認(ren)(ren)定(ding)(ding)(ding)權利密不(bu)可分,不(bu)能割(ge)裂(lie)。當(dang)地(di)工(gong)傷認(ren)(ren)定(ding)(ding)(ding)部(bu)門作(zuo)出的(de)(de)不(bu)予受理(li)的(de)(de)決定(ding)(ding)(ding)不(bu)符合《工(gong)傷保險條例》的(de)(de)立法精神及相關規(gui)定(ding)(ding)(ding),撤銷當(dang)地(di)工(gong)傷認(ren)(ren)定(ding)(ding)(ding)機(ji)(ji)構(gou)不(bu)予受理(li)決定(ding)(ding)(ding),責令在規(gui)定(ding)(ding)(ding)時間內重新做出具體(ti)行(xing)政(zheng)行(xing)為(wei)。

五種情況可不計算在工傷認定申請期限內

記者從(cong)市人(ren)(ren)(ren)社局(ju)工(gong)(gong)(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)(ding)部(bu)門(men)了解(jie)到,該案件(jian)(jian)的(de)主要分歧由于個人(ren)(ren)(ren)與單(dan)(dan)位(wei)確認(ren)(ren)勞(lao)動(dong)(dong)關(guan)(guan)系,導致超過(guo)了1年工(gong)(gong)(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)(ding)申(shen)請(qing)期(qi)(qi)限。那么,在確認(ren)(ren)勞(lao)動(dong)(dong)關(guan)(guan)系訴(su)訟期(qi)(qi)間(jian)的(de)時間(jian)是(shi)否(fou)應(ying)該扣除(chu)?根據最高人(ren)(ren)(ren)民(min)法院 《關(guan)(guan)于審理(li)工(gong)(gong)(gong)傷(shang)(shang)(shang)保(bao)(bao)險(xian)行政(zheng)案件(jian)(jian)若干問題的(de)規定(ding)(ding) 》(法釋〔2014〕9號(hao) )的(de)規定(ding)(ding):由于不(bu)屬(shu)(shu)于職工(gong)(gong)(gong)或者其近親屬(shu)(shu)自(zi)身原因超過(guo)工(gong)(gong)(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)(ding)申(shen)請(qing)期(qi)(qi)限的(de),被耽(dan)誤(wu)的(de)時間(jian)不(bu)計算在工(gong)(gong)(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)(ding)申(shen)請(qing)期(qi)(qi)限內。 有下列情形之(zhi)一的(de),應(ying)當(dang)從(cong)工(gong)(gong)(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)(ding)申(shen)請(qing)期(qi)(qi)中扣除(chu)。一是(shi)不(bu)可(ke)抗(kang)力;二是(shi)人(ren)(ren)(ren)身自(zi)由受到限制;三是(shi)屬(shu)(shu)于用人(ren)(ren)(ren)單(dan)(dan)位(wei)原因;四(si)是(shi)社會保(bao)(bao)險(xian)行政(zheng)部(bu)門(men)登記制度不(bu)完善;五是(shi)當(dang)事人(ren)(ren)(ren)對是(shi)否(fou)存在勞(lao)動(dong)(dong)關(guan)(guan)系申(shen)請(qing)仲裁、提起民(min)事訴(su)訟。 因此(ci),張某確認(ren)(ren)勞(lao)動(dong)(dong)關(guan)(guan)系的(de)時間(jian)應(ying)當(dang)從(cong)工(gong)(gong)(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)(ding)申(shen)請(qing)期(qi)(qi)限中扣除(chu),扣除(chu)后工(gong)(gong)(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)(ding)申(shen)請(qing)期(qi)(qi)限不(bu)超過(guo)一年的(de),工(gong)(gong)(gong)傷(shang)(shang)(shang)認(ren)(ren)定(ding)(ding)部(bu)門(men)應(ying)當(dang)受理(li)。

勞動(dong)(dong)能(neng)力鑒(jian)定作為工(gong)(gong)傷(shang)保險工(gong)(gong)作的“三個(ge)環節”(工(gong)(gong)傷(shang)認定、勞動(dong)(dong)能(neng)力鑒(jian)定、待遇給付)之(zhi)一,是工(gong)(gong)傷(shang)職工(gong)(gong)領取工(gong)(gong)傷(shang)待遇的必要環節,為便于工(gong)(gong)傷(shang)職工(gong)(gong)更好地維護工(gong)(gong)傷(shang)權益(yi),下面介紹我市勞動(dong)(dong)能(neng)力鑒(jian)定相關知識及政策。

勞(lao)動(dong)(dong)(dong)能力(li)鑒(jian)定(ding)(ding)是指勞(lao)動(dong)(dong)(dong)者(zhe)因工負傷或患職(zhi)業(ye)病等(deng)原(yuan)因,導致本人勞(lao)動(dong)(dong)(dong)與社會生(sheng)(sheng)活(huo)能力(li)受(shou)(shou)到不同影(ying)響(xiang),為享受(shou)(shou)相應的(de)(de)工傷保(bao)險待遇(yu),由市勞(lao)動(dong)(dong)(dong)能力(li)鑒(jian)定(ding)(ding)機構根據勞(lao)動(dong)(dong)(dong)者(zhe)本人或者(zhe)近親屬(shu)的(de)(de)申(shen)請,組(zu)織有資質的(de)(de)醫(yi)(yi)療衛生(sheng)(sheng)專家,依(yi)據國家《職(zhi)工工傷與職(zhi)業(ye)病鑒(jian)定(ding)(ding)致殘(can)程(cheng)度標準》(GB/T16180-2014),運用醫(yi)(yi)學(xue)(xue)科(ke)學(xue)(xue)技術的(de)(de)檢查方法和手段做出(chu)的(de)(de)技術性結論,對工傷職(zhi)工的(de)(de)勞(lao)動(dong)(dong)(dong)功能障(zhang)礙(ai)程(cheng)度和生(sheng)(sheng)活(huo)自理障(zhang)礙(ai)的(de)(de)程(cheng)度做出(chu)等(deng)級(ji)鑒(jian)定(ding)(ding)。

勞動能力的等級

勞動能力分(fen)為(wei)勞動功(gong)能障(zhang)(zhang)礙(ai)程度和(he)生(sheng)活(huo)自(zi)理(li)障(zhang)(zhang)礙(ai)程度兩方面。其中,勞動功(gong)能障(zhang)(zhang)礙(ai)程度分(fen)為(wei)十(shi)個傷殘等(deng)級,最(zui)(zui)重的(de)為(wei)一級,最(zui)(zui)輕的(de)為(wei)十(shi)級。生(sheng)活(huo)自(zi)理(li)障(zhang)(zhang)礙(ai)分(fen)為(wei)三個等(deng)級:生(sheng)活(huo)完(wan)全不(bu)能自(zi)理(li)、生(sheng)活(huo)大部分(fen)不(bu)能自(zi)理(li)和(he)生(sheng)活(huo)部分(fen)不(bu)能自(zi)理(li)。

勞動能力鑒定的申請條件

職工發生(sheng)工傷,經治(zhi)療傷情相對穩定或停工留薪期滿(man)后,存(cun)在殘疾、影響(xiang)勞(lao)動能力的,均可以(yi)申請勞(lao)動能力鑒定。

勞動能力鑒定的一般程序

髴(fu)申(shen)請(qing)(qing)及(ji)受理:職工(gong)(gong)(gong)傷(shang)(shang)情相(xiang)對(dui)穩定(ding)(ding)(ding)或(huo)(huo)停(ting)(ting)工(gong)(gong)(gong)留薪期(qi)滿(man)后,由用(yong)人單位(wei)、工(gong)(gong)(gong)傷(shang)(shang)職工(gong)(gong)(gong)或(huo)(huo)者其近親(qin)屬向單位(wei)繳納(na)工(gong)(gong)(gong)傷(shang)(shang)保(bao)險所在區市(shi)(shi)社會保(bao)險經辦機構(gou)提交《青(qing)島(dao)市(shi)(shi)勞(lao)動(dong)能(neng)力(li)鑒(jian)(jian)定(ding)(ding)(ding)申(shen)請(qing)(qing)表》一式一份,加蓋(gai)單位(wei)公章、粘貼(tie)申(shen)請(qing)(qing)人近期(qi)一寸彩照一張(zhang)。同時(shi)提交以下材料:1、《工(gong)(gong)(gong)傷(shang)(shang)認定(ding)(ding)(ding)書(shu)》原件及(ji)復(fu)印(yin)件;2、用(yong)人單位(wei)開(kai)具的(de) 《工(gong)(gong)(gong)傷(shang)(shang)職工(gong)(gong)(gong)停(ting)(ting)工(gong)(gong)(gong)留薪期(qi)確認通知(zhi)(zhi)書(shu)》,用(yong)人單位(wei)不給開(kai)具的(de),本(ben)人應提交申(shen)請(qing)(qing)書(shu)面材料;3、受傷(shang)(shang)部位(wei)恢復(fu)穩定(ding)(ding)(ding)的(de)彩色(se)照片;4、發(fa)生工(gong)(gong)(gong)傷(shang)(shang)后的(de)原始病歷(li)(li)以及(ji)相(xiang)關的(de)檢查、化驗報(bao)告(gao)等(deng)有效(xiao)復(fu)印(yin)件;5、職業(ye)病的(de)應提供《青(qing)島(dao)市(shi)(shi)職業(ye)病診(zhen)斷(duan)證明》復(fu)印(yin)件;6、住(zhu)院病歷(li)(li)需加蓋(gai)醫院公章。對(dui)申(shen)請(qing)(qing)材料齊(qi)全有效(xiao)的(de),發(fa)給申(shen)請(qing)(qing)人《青(qing)島(dao)市(shi)(shi)勞(lao)動(dong)能(neng)力(li)鑒(jian)(jian)定(ding)(ding)(ding)通知(zhi)(zhi)書(shu)》,載明鑒(jian)(jian)定(ding)(ding)(ding)時(shi)間、地點及(ji)相(xiang)關要求;對(dui)材料不齊(qi)全的(de),發(fa)給申(shen)請(qing)(qing)人 《青(qing)島(dao)市(shi)(shi)勞(lao)動(dong)能(neng)力(li)鑒(jian)(jian)定(ding)(ding)(ding)申(shen)請(qing)(qing)材料收訖補正告(gao)知(zhi)(zhi)書(shu)》,一次性告(gao)知(zhi)(zhi)申(shen)請(qing)(qing)人及(ji)時(shi)補齊(qi)材料。

髵組織醫療檢查及鑒(jian)(jian)定(ding)(ding):市勞(lao)動(dong)(dong)能(neng)(neng)力(li)鑒(jian)(jian)定(ding)(ding)委(wei)員會收到勞(lao)動(dong)(dong)能(neng)(neng)力(li)鑒(jian)(jian)定(ding)(ding)申請后,從市醫療衛生專家(jia)(jia)庫中隨(sui)機(ji)抽取相關醫療專家(jia)(jia)組成專家(jia)(jia)組,由專家(jia)(jia)組根據現(xian)場醫學(xue)檢查情(qing)況(kuang)提出勞(lao)動(dong)(dong)能(neng)(neng)力(li)鑒(jian)(jian)定(ding)(ding)意見,市勞(lao)動(dong)(dong)能(neng)(neng)力(li)鑒(jian)(jian)定(ding)(ding)委(wei)員會根據專家(jia)(jia)組的(de)鑒(jian)(jian)定(ding)(ding)意見作出工傷職工勞(lao)動(dong)(dong)能(neng)(neng)力(li)鑒(jian)(jian)定(ding)(ding)結論。

報告施救

職(zhi)工(gong)(gong)發生工(gong)(gong)傷(shang)事(shi)故后,本人或同事(shi)應(ying)當在第一時(shi)間(jian)通(tong)知所在單位的(de)(de)安全(quan)生產管理部門的(de)(de)負(fu)責人,保(bao)(bao)護好事(shi)故現場,并根據職(zhi)工(gong)(gong)受傷(shang)情(qing)況(kuang),及時(shi)將(jiang)受傷(shang)職(zhi)工(gong)(gong)送往(wang)工(gong)(gong)傷(shang)保(bao)(bao)險協議醫療機構進行救(jiu)治,情(qing)況(kuang)緊急(ji)時(shi),可以先到就近(jin)醫院急(ji)救(jiu),病情(qing)穩定后應(ying)及時(shi)轉入(ru)工(gong)(gong)傷(shang)保(bao)(bao)險協議醫療機構治療。

事故調查

用人(ren)(ren)單位對工(gong)(gong)傷(shang)(shang)事故現場進(jin)行調(diao)查(cha)(cha),對事故現場進(jin)行拍照(zhao)、錄(lu)音、錄(lu)像(xiang)等,做好調(diao)查(cha)(cha)取證(zheng)(zheng)(zheng)(zheng)等工(gong)(gong)作,分析事故原因(yin),寫出工(gong)(gong)傷(shang)(shang)事故報(bao)告,并(bing)準備好工(gong)(gong)傷(shang)(shang)認(ren)定(ding)的(de)(de)(de)相關(guan)材料(liao)。一是(shi)填寫《工(gong)(gong)傷(shang)(shang)認(ren)定(ding)申(shen)請表》;二是(shi)受(shou)傷(shang)(shang)害職工(gong)(gong)的(de)(de)(de)有(you)(you)效身份證(zheng)(zheng)(zheng)(zheng)明;三是(shi)勞動合同文本復印件或者與用人(ren)(ren)單位存在(zai)勞動關(guan)系(xi) (包括事實勞動關(guan)系(xi))的(de)(de)(de)有(you)(you)效證(zheng)(zheng)(zheng)(zheng)明材料(liao);四是(shi)用人(ren)(ren)單位事故調(diao)查(cha)(cha)報(bao)告書 (個人(ren)(ren)申(shen)報(bao)的(de)(de)(de)不必提(ti)供);五是(shi)兩人(ren)(ren)以上(shang)的(de)(de)(de)證(zheng)(zheng)(zheng)(zheng)人(ren)(ren)證(zheng)(zheng)(zheng)(zheng)言(附身份證(zheng)(zheng)(zheng)(zheng)明復印件);六是(shi)醫療機構出具的(de)(de)(de)受(shou)傷(shang)(shang)后診(zhen)斷證(zheng)(zheng)(zheng)(zheng)明書、初診(zhen)病(bing)歷、住(zhu)院病(bing)歷,屬職業病(bing)的(de)(de)(de)提(ti)供合法有(you)(you)效的(de)(de)(de)職業病(bing)診(zhen)斷證(zheng)(zheng)(zheng)(zheng)明書或鑒定(ding)書。

特殊情況(kuang)的(de)(de)(de)除(chu)提(ti)供上述(shu)材料外,還應當(dang)(dang)分(fen)別提(ti)交(jiao)(jiao)相應證(zheng)(zheng)(zheng)據。一是(shi)職(zhi)工(gong)(gong)(gong)死亡(wang)的(de)(de)(de),提(ti)交(jiao)(jiao)死亡(wang)證(zheng)(zheng)(zheng)明(ming)(ming);二是(shi)因(yin)履行工(gong)(gong)(gong)作職(zhi)責(ze)或因(yin)工(gong)(gong)(gong)外出受(shou)(shou)到暴(bao)力傷害的(de)(de)(de),提(ti)交(jiao)(jiao)公安(an)部(bu)門(men)的(de)(de)(de)證(zheng)(zheng)(zheng)明(ming)(ming)或其他相關證(zheng)(zheng)(zheng)明(ming)(ming);三是(shi)上下班途(tu)中,受(shou)(shou)到交(jiao)(jiao)通事(shi)(shi)(shi)故(gu)(gu)(gu)或者(zhe)(zhe)客運輪渡、火車事(shi)(shi)(shi)故(gu)(gu)(gu)傷害的(de)(de)(de),提(ti)交(jiao)(jiao)公安(an)交(jiao)(jiao)警(jing)部(bu)門(men)出具的(de)(de)(de) 《交(jiao)(jiao)通事(shi)(shi)(shi)故(gu)(gu)(gu)責(ze)任認定(ding)書》或其他主管行政(zheng)部(bu)門(men)的(de)(de)(de)事(shi)(shi)(shi)故(gu)(gu)(gu)責(ze)任認定(ding)證(zheng)(zheng)(zheng)明(ming)(ming);四是(shi)在搶險救災(zai)等維護國家利益、公共利益活動中受(shou)(shou)到傷害的(de)(de)(de),提(ti)交(jiao)(jiao)民政(zheng)部(bu)門(men)或者(zhe)(zhe)其他相關部(bu)門(men)的(de)(de)(de)證(zheng)(zheng)(zheng)明(ming)(ming);五是(shi)在工(gong)(gong)(gong)作時(shi)(shi)間和(he)工(gong)(gong)(gong)作崗位、突發(fa)(fa)(fa)疾病死亡(wang)或者(zhe)(zhe)在48小時(shi)(shi)之內經搶救無(wu)效死亡(wang)的(de)(de)(de),提(ti)交(jiao)(jiao)醫(yi)療(liao)機構的(de)(de)(de)搶救證(zheng)(zheng)(zheng)明(ming)(ming);六是(shi)屬于因(yin)戰、因(yin)公負傷致殘的(de)(de)(de)轉業、復(fu)員軍人(ren)(ren),舊傷復(fu)發(fa)(fa)(fa)的(de)(de)(de),提(ti)交(jiao)(jiao)《革命傷殘軍人(ren)(ren)證(zheng)(zheng)(zheng)》以及(ji)勞動能力鑒定(ding)機構對舊傷復(fu)發(fa)(fa)(fa)的(de)(de)(de)確認;七是(shi)單(dan)位未參加(jia)工(gong)(gong)(gong)傷保險的(de)(de)(de),應當(dang)(dang)提(ti)交(jiao)(jiao)營業執照副(fu)本或者(zhe)(zhe)工(gong)(gong)(gong)商行政(zheng)管理部(bu)門(men)出具的(de)(de)(de)查詢(xun)證(zheng)(zheng)(zheng)明(ming)(ming)。

按時申報

職(zhi)工(gong)發生事故傷(shang)害或(huo)者(zhe)被診(zhen)斷(duan)、鑒定(ding)(ding)為(wei)職(zhi)業(ye)病的,所在單(dan)(dan)位(wei)應當自事故傷(shang)害發生之(zhi)日或(huo)者(zhe)被診(zhen)斷(duan)、鑒定(ding)(ding)為(wei)職(zhi)業(ye)病之(zhi)日起30日內(nei),向用人單(dan)(dan)位(wei)所在地工(gong)傷(shang)認(ren)定(ding)(ding)部門提出工(gong)傷(shang)認(ren)定(ding)(ding)申請。遇有(you)特殊情況(kuang),經報工(gong)傷(shang)認(ren)定(ding)(ding)部門同意,申請時(shi)限可以(yi)適當延長,但延長時(shi)間不(bu)得超(chao)過(guo)30日。

用人(ren)單(dan)(dan)位(wei)未在(zai)規定(ding)(ding)(ding)的30日內提(ti)出工(gong)(gong)傷(shang)認定(ding)(ding)(ding)申(shen)請(qing)的,工(gong)(gong)傷(shang)職(zhi)工(gong)(gong)或(huo)(huo)者其近親屬、工(gong)(gong)會組織在(zai)事故傷(shang)害(hai)發生(sheng)之日或(huo)(huo)被診斷、鑒定(ding)(ding)(ding)為職(zhi)業(ye)病(bing)之日起(qi)1年(nian)內,可以直(zhi)接向用人(ren)單(dan)(dan)位(wei)所在(zai)地工(gong)(gong)傷(shang)認定(ding)(ding)(ding)部(bu)門提(ti)出工(gong)(gong)傷(shang)認定(ding)(ding)(ding)申(shen)請(qing)。用人(ren)單(dan)(dan)位(wei)未在(zai)規定(ding)(ding)(ding)時限內提(ti)交工(gong)(gong)傷(shang)認定(ding)(ding)(ding)申(shen)請(qing),在(zai)此期間發生(sheng)符合(he)工(gong)(gong)傷(shang)保險條例(li)規定(ding)(ding)(ding)的工(gong)(gong)傷(shang)待(dai)遇等(deng)有關費用由(you)(you)該用人(ren)單(dan)(dan)位(wei)負擔。發生(sheng)工(gong)(gong)傷(shang)事故或(huo)(huo)確診為職(zhi)業(ye)病(bing)之日起(qi),超過(guo)(guo)一年(nian)未提(ti)出工(gong)(gong)傷(shang)認定(ding)(ding)(ding)申(shen)請(qing)的,工(gong)(gong)傷(shang)認定(ding)(ding)(ding)部(bu)門部(bu)門不予受理,由(you)(you)此發生(sheng)的待(dai)遇問題由(you)(you)受傷(shang)職(zhi)工(gong)(gong)或(huo)(huo)其親屬、工(gong)(gong)會組織與(yu)用人(ren)單(dan)(dan)位(wei)協商解決(jue)或(huo)(huo)通過(guo)(guo)法律途(tu)徑解決(jue)。

工(gong)(gong)(gong)(gong)(gong)傷(shang)認(ren)定(ding)(ding)按照屬地(di)(di)原則管理。用(yong)人單位工(gong)(gong)(gong)(gong)(gong)商(shang)登(deng)記(ji)注冊(ce)(ce)地(di)(di)與生產(chan)經營(ying)地(di)(di)不在(zai)同(tong)一行(xing)政地(di)(di)域(yu),用(yong)人單位參加工(gong)(gong)(gong)(gong)(gong)傷(shang)保(bao)險的(de),向(xiang)(xiang)參保(bao)地(di)(di)工(gong)(gong)(gong)(gong)(gong)傷(shang)認(ren)定(ding)(ding)機構提出申請;未(wei)參加工(gong)(gong)(gong)(gong)(gong)傷(shang)保(bao)險的(de),向(xiang)(xiang)生產(chan)經營(ying)地(di)(di)工(gong)(gong)(gong)(gong)(gong)傷(shang)認(ren)定(ding)(ding)機構進行(xing)申請。生產(chan)經營(ying)地(di)(di)在(zai)國外(wai)且受(shou)(shou)傷(shang)害職工(gong)(gong)(gong)(gong)(gong)未(wei)在(zai)生產(chan)經營(ying)地(di)(di)參加工(gong)(gong)(gong)(gong)(gong)傷(shang)保(bao)險的(de),向(xiang)(xiang)用(yong)人單位工(gong)(gong)(gong)(gong)(gong)商(shang)登(deng)記(ji)注冊(ce)(ce)所在(zai)地(di)(di)的(de)工(gong)(gong)(gong)(gong)(gong)傷(shang)認(ren)定(ding)(ding)機構進行(xing)申請。青島市(shi)(shi)工(gong)(gong)(gong)(gong)(gong)傷(shang)認(ren)定(ding)(ding)部(bu)門(men)負責(ze)受(shou)(shou)理市(shi)(shi)內(nei)三(san)區(qu)(市(shi)(shi)南區(qu)、市(shi)(shi)北區(qu)、李滄區(qu))工(gong)(gong)(gong)(gong)(gong)傷(shang)認(ren)定(ding)(ding)申請,其他(ta)區(qu)市(shi)(shi)負責(ze)本轄區(qu)內(nei)工(gong)(gong)(gong)(gong)(gong)傷(shang)認(ren)定(ding)(ding)申請。

配合調查

工傷認(ren)定(ding)機(ji)構受理(li)工傷認(ren)定(ding)申請后,可(ke)以(yi)根據審核(he)(he)需要對事故(gu)傷害進行(xing)調查核(he)(he)實,用人單位、職(zhi)工、工會(hui)組織(zhi)、醫療機(ji)構以(yi)及有關部門(men)應當予以(yi)協助。對拒不協助調查的,由社(she)會(hui)保險行(xing)政(zheng)部門(men)責(ze)令改(gai)正,處2000元以(yi)上2萬元以(yi)下的罰款。
