標準工作時間以外的加班應該給多少工資?

答 《工(gong)資(zi)(zi)支付(fu)暫行規定(ding)》規定(ding),用(yong)人單(dan)位依法安排勞動(dong)(dong)者(zhe)在(zai)標準工(gong)作時間(jian)(jian)以(yi)外(wai)工(gong)作的,應當(dang)按照(zhao)下(xia)列標準支付(fu)勞動(dong)(dong)者(zhe)加班工(gong)資(zi)(zi): (1)在(zai)日(ri)(ri)標準工(gong)作時間(jian)(jian)以(yi)外(wai)延長工(gong)作時間(jian)(jian)的,按照(zhao)不(bu)低(di)于小(xiao)時工(gong)資(zi)(zi)基數的150%支付(fu)加班工(gong)資(zi)(zi); (2)在(zai)休息日(ri)(ri)工(gong)作的,應當(dang)安排其同等時間(jian)(jian)的補休,不(bu)能安排補休的,按照(zhao)不(bu)低(di)于日(ri)(ri)或(huo)者(zhe)小(xiao)時工(gong)資(zi)(zi)基數的200%支付(fu)加班工(gong)資(zi)(zi); (3)在(zai)法定(ding)休假日(ri)(ri)工(gong)作的,應當(dang)按照(zhao)不(bu)低(di)于日(ri)(ri)或(huo)者(zhe)小(xiao)時工(gong)資(zi)(zi)基數的300%支付(fu)加班工(gong)資(zi)(zi)。
