答(da) 《工(gong)(gong)(gong)資(zi)(zi)支付(fu)(fu)(fu)暫行規定》規定,用人單位(wei)依法安(an)(an)排(pai)(pai)勞動者在(zai)標準(zhun)(zhun)工(gong)(gong)(gong)作(zuo)(zuo)時間以(yi)外(wai)(wai)工(gong)(gong)(gong)作(zuo)(zuo)的,應(ying)當(dang)按(an)照(zhao)(zhao)下列標準(zhun)(zhun)支付(fu)(fu)(fu)勞動者加班(ban)工(gong)(gong)(gong)資(zi)(zi): (1)在(zai)日(ri)標準(zhun)(zhun)工(gong)(gong)(gong)作(zuo)(zuo)時間以(yi)外(wai)(wai)延長工(gong)(gong)(gong)作(zuo)(zuo)時間的,按(an)照(zhao)(zhao)不(bu)(bu)低于小時工(gong)(gong)(gong)資(zi)(zi)基(ji)數的150%支付(fu)(fu)(fu)加班(ban)工(gong)(gong)(gong)資(zi)(zi); (2)在(zai)休息日(ri)工(gong)(gong)(gong)作(zuo)(zuo)的,應(ying)當(dang)安(an)(an)排(pai)(pai)其同等時間的補休,不(bu)(bu)能安(an)(an)排(pai)(pai)補休的,按(an)照(zhao)(zhao)不(bu)(bu)低于日(ri)或者小時工(gong)(gong)(gong)資(zi)(zi)基(ji)數的200%支付(fu)(fu)(fu)加班(ban)工(gong)(gong)(gong)資(zi)(zi); (3)在(zai)法定休假(jia)日(ri)工(gong)(gong)(gong)作(zuo)(zuo)的,應(ying)當(dang)按(an)照(zhao)(zhao)不(bu)(bu)低于日(ri)或者小時工(gong)(gong)(gong)資(zi)(zi)基(ji)數的300%支付(fu)(fu)(fu)加班(ban)工(gong)(gong)(gong)資(zi)(zi)。
