公司以未完成銷售額為由拒付工資合法嗎?
問 上個(ge)月(yue),我(wo)一直很努力的工作,但是(shi)還(huan)是(shi)沒有完(wan)成銷(xiao)售(shou)(shou)額(e),公(gong)司領導很生氣,以(yi)未(wei)完(wan)成銷(xiao)售(shou)(shou)額(e)為由拒絕發(fa)給我(wo)工資,公(gong)司這么(me)做合法嗎?
答(da) 《勞動合同法(fa)》第(di)20條(tiao)規定(ding):“勞動者(zhe)在試用期(qi)的工(gong)(gong)(gong)資(zi)不(bu)得(de)低(di)于本單位相(xiang)同崗位 最(zui)(zui)低(di)檔工(gong)(gong)(gong)資(zi)或(huo)者(zhe)勞動合同約定(ding)工(gong)(gong)(gong)資(zi)的百(bai)分(fen)之八十,并不(bu)得(de)低(di)于用人單位所(suo)在地的最(zui)(zui) 低(di)工(gong)(gong)(gong)資(zi)標準。”你雖(sui)然未完成銷(xiao)售額,但是(shi)已經付出(chu)努力和常(chang)常(chang)勞動,公(gong)司付給(gei)你的工(gong)(gong)(gong)資(zi)也不(bu)得(de)低(di)于所(suo)在地的最(zui)(zui)低(di)工(gong)(gong)(gong)資(zi)標準,拒(ju)付工(gong)(gong)(gong)資(zi)是(shi)不(bu)合理(li)的。
