中秋節加班公司該支付加班費嗎?

答 根(gen)據國家規定(ding)(ding)(ding): 1、在法(fa)定(ding)(ding)(ding)節假日工作的,應(ying)當按照不(bu)低(di)于日或(huo)者(zhe)小時(shi)工資(zi)基數(shu)的300%支付加(jia)班(ban)工資(zi)。2、計算加(jia)班(ban)工資(zi)的基數(shu)應(ying)以:按勞(lao)動(dong)合同(tong)(tong)約定(ding)(ding)(ding)的勞(lao)動(dong)者(zhe)本人(ren)(ren)的工資(zi)標準確(que)定(ding)(ding)(ding);勞(lao)動(dong)合同(tong)(tong)沒(mei)有約定(ding)(ding)(ding),按集體(ti)合同(tong)(tong)約定(ding)(ding)(ding)的加(jia)班(ban)工資(zi)基數(shu)確(que)定(ding)(ding)(ding);勞(lao)動(dong)合同(tong)(tong)、集體(ti)合同(tong)(tong)均未約定(ding)(ding)(ding)的,按勞(lao)動(dong)者(zhe)本人(ren)(ren)正常(chang)勞(lao)動(dong)應(ying)得的工資(zi)確(que)定(ding)(ding)(ding)。 3、經批準實行不(bu)定(ding)(ding)(ding)時(shi)工作制的勞(lao)動(dong)者(zhe),用人(ren)(ren)單位可以不(bu)支付加(jia)班(ban)工資(zi)。
