用人單位不安排職工休年假的應支付給職工額外工資嗎?

我們單位(wei)滿一(yi)年(nian)的職工(gong)有(you)年(nian)休,但是用人單位(wei)有(you)時不安排(pai)員工(gong)年(nian)休,或者給予(yu)員工(gong)的年(nian)休時間比法定(ding)標準低,那請(qing)問年(nian)休未休的幾(ji)天,單位(wei)應該支付(fu)給職工(gong)額外(wai)工(gong)資嗎?

《企業(ye)職工(gong)(gong)帶薪年休(xiu)假實施辦法》第十(shi)條規定(ding):“用人單(dan)位經職工(gong)(gong)同意不(bu)安排(pai)年休(xiu)假或(huo)者(zhe)安排(pai)職工(gong)(gong)年休(xiu)假天數少于應休(xiu)年休(xiu)假天數,應當在本年度內對職工(gong)(gong)應休(xiu)未(wei)休(xiu)年休(xiu)假天數,按照(zhao)其(qi)日工(gong)(gong)資(zi)收入的300%支付(fu)未(wei)休(xiu)年休(xiu)假工(gong)(gong)資(zi)報酬(chou),其(qi)中包含用人單(dan)位支付(fu)職工(gong)(gong)正常工(gong)(gong)作期間(jian)的工(gong)(gong)資(zi)收入。”因此,單(dan)位不(bu)安排(pai)年休(xiu)或(huo)者(zhe)安排(pai)休(xiu)的年休(xiu)假比法定(ding)標準低的,應該要支付(fu)額外(wai)工(gong)(gong)資(zi),即3倍工(gong)(gong)資(zi)。
