用人單位不安排職工休年假的應支付給職工額外工資嗎?
問 我們單(dan)位滿一年(nian)(nian)的職工(gong)有年(nian)(nian)休,但(dan)是用人單(dan)位有時不安(an)排員(yuan)工(gong)年(nian)(nian)休,或者給予員(yuan)工(gong)的年(nian)(nian)休時間比法定標準低(di),那請問(wen)年(nian)(nian)休未休的幾天(tian),單(dan)位應該(gai)支(zhi)付給職工(gong)額外工(gong)資嗎(ma)?
答(da) 《企業(ye)職工(gong)(gong)帶薪年休(xiu)(xiu)(xiu)假(jia)(jia)實施辦(ban)法》第十條規(gui)定(ding):“用人單位(wei)經職工(gong)(gong)同意不安(an)排年休(xiu)(xiu)(xiu)假(jia)(jia)或(huo)者(zhe)安(an)排職工(gong)(gong)年休(xiu)(xiu)(xiu)假(jia)(jia)天數少于應休(xiu)(xiu)(xiu)年休(xiu)(xiu)(xiu)假(jia)(jia)天數,應當在本年度內對(dui)職工(gong)(gong)應休(xiu)(xiu)(xiu)未休(xiu)(xiu)(xiu)年休(xiu)(xiu)(xiu)假(jia)(jia)天數,按照(zhao)其日工(gong)(gong)資(zi)收(shou)入的(de)(de)300%支(zhi)付(fu)未休(xiu)(xiu)(xiu)年休(xiu)(xiu)(xiu)假(jia)(jia)工(gong)(gong)資(zi)報(bao)酬,其中包(bao)含(han)用人單位(wei)支(zhi)付(fu)職工(gong)(gong)正常工(gong)(gong)作期間的(de)(de)工(gong)(gong)資(zi)收(shou)入。”因此,單位(wei)不安(an)排年休(xiu)(xiu)(xiu)或(huo)者(zhe)安(an)排休(xiu)(xiu)(xiu)的(de)(de)年休(xiu)(xiu)(xiu)假(jia)(jia)比(bi)法定(ding)標準低的(de)(de),應該要支(zhi)付(fu)額(e)外工(gong)(gong)資(zi),即3倍工(gong)(gong)資(zi)。
