我們單位(wei)這月(yue)有部分(fen)員(yuan)(yuan)工(gong)(gong)(gong)的(de)工(gong)(gong)(gong)資(zi)(zi)還如本市(shi)最(zui)低(di)工(gong)(gong)(gong)資(zi)(zi)標(biao)準(zhun)高,單位(wei)說因為包(bao)吃住(zhu),請問(wen)用人單位(wei)包(bao)吃住(zhu)就可以支付(fu)低(di)于最(zui)低(di)工(gong)(gong)(gong)作標(biao)準(zhun)的(de)工(gong)(gong)(gong)資(zi)(zi)給(gei)員(yuan)(yuan)工(gong)(gong)(gong)嗎?

不可(ke)以。用人單位支(zhi)付(fu)給(gei)勞動者(zhe)的(de)工(gong)(gong)資必須(xu)以法(fa)定(ding)貨(huo)幣形式支(zhi)付(fu)。對勞動者(zhe)包吃住(zhu),屬于(yu)用人單位給(gei)予職(zhi)工(gong)(gong)的(de)福利(li),用人單位不能將此計算在工(gong)(gong)資之內,更不能因此使支(zhi)付(fu)的(de)貨(huo)幣工(gong)(gong)資低(di)于(yu)最低(di)工(gong)(gong)資標準。
