最低工資標準能包含加班費嗎?
問(wen) 我是一(yi)(yi)名試(shi)用(yong)期(qi)員工(gong),現在(zai)山東省一(yi)(yi)家(jia)私企(qi)工(gong)作,公司(si)發給試(shi)用(yong)期(qi)員工(gong)的工(gong)資是最(zui)低工(gong)資標準,端午(wu)節期(qi)間我一(yi)(yi)直都在(zai)公司(si)加(jia)班,最(zui)低工(gong)資標準能包含加(jia)班費嗎?
答 勞(lao)動(dong)(dong)(dong)(dong)和(he)社會保障部(bu)頒布的《最(zui)低工(gong)(gong)資(zi)(zi)(zi)規(gui)(gui)定》第十二條(tiao)規(gui)(gui)定: 在勞(lao)動(dong)(dong)(dong)(dong)者提供正常(chang)勞(lao)動(dong)(dong)(dong)(dong)的情況下(xia)(xia)(xia),用人單位應支(zhi)付給勞(lao)動(dong)(dong)(dong)(dong)者的工(gong)(gong)資(zi)(zi)(zi)在剔除(chu)下(xia)(xia)(xia)列各項以后(hou),不(bu)得低于當地最(zui)低工(gong)(gong)資(zi)(zi)(zi)標準(zhun): (一(yi))延長(chang)工(gong)(gong)作時間工(gong)(gong)資(zi)(zi)(zi); (二)中班、夜班、高溫(wen)、低溫(wen)、井下(xia)(xia)(xia)、有毒有害等特殊(shu)工(gong)(gong)作環(huan)境(jing)、條(tiao)件下(xia)(xia)(xia)的津貼; (三)法律(lv)、法規(gui)(gui)和(he)國家規(gui)(gui)定的勞(lao)動(dong)(dong)(dong)(dong)者福利待遇等。 所以你(ni)的工(gong)(gong)資(zi)(zi)(zi)不(bu)應包含(han)加班費。
